SUBJECT: Legislation: AB 2531 (Moore)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of opposition to AB 2531.
BACKGROUND:
Existing law prohibits discrimination in employment on the basis of several
enumerated factors. This bill would make it an unlawful employment practice for
any employer to refuse to permit any employee to take a leave of up to one year
for child rearing, and would permit an employee to utilize any accrued vacation
leave and sick leave during this period.
This bill would impose a state-mandated local program by requiring public agencies to
permit their employees to take a leave of up to one year for child rearing.
Both the Director of Personnel and Affirmative Action Officer recommend that the
Board oppose AB 2531 because it exceeds the requirements of federal law and treats
a child-rearing leave of absence differently than any other disability leave of
absence. The County already has the discretion to grant such a leave and AB 2531
would remove this discretion from the County as an employer.
AB 2531 is scheduled to be heard in the Assembly Labor and Employment Committee on
April 3, 1984.
