Hearing on recommendation of County Planning Commission with respect to rezoning application 2585-RZ , and Development Plan #3055-83 filed by Perma-Bilt Homes (applicant) , Ron Carter (owner) , Pleasant Hill BARTD Station area. This being the time fixed for hearing on the recommendation of the County Planning Commission with respect to application 2585-RZ , and Development Plan 3055-83 , filed by Perma-Bilt Homes (applicant) , and Ron Carter (owner) , to rezone approximately 2. 78 acres of land from Single Family Residen- tial District (R-15) , and Single Family Residential District Transition (R-15=T) to Planned Unit District (P-1) , in the Pleasant Hill BARTD Station area; and Harvey Bragdon, Assistant Director of Planning, having described the property site and having advised that a . Negative Declaration of Environmental Significance has been filed for the proposal ; and The Chairman having opened the public hearing; and Larry Gossett, representing Cunha and Associates , having appeared and advised that he had no presentation prepared, but that he was available to answer any questions of Board members concerning this project; and The Chairman having closed the public hearing; and Board members having considered the matter, IT IS ORDERED that rezoning application 2585-RZ is APPROVED as recommended by the County Planning Commission subject to conditions imposed by the County Public Works Department, Exhibit A attached hereto and by reference incorporated herein, and that Development Plan (#3055-83) t is APPROVED subject to conditions imposed by the Planning Commission and the County Public Works Department, Exhibit B attached hereto and by reference incorporated herein, and the Board hereby adopts the Planning Commission' s reasons, set forth in its Resolution Number 26-1984 , as its determinations for this decision. The final development plan for this project will require conformance to the provisions of Division 91.4 and Division 1006 of the County Ordinance Code and supplemented as follows: I . The project will be required to collect and convey its storm waters via Line 0-1 of Drainage Area 44B. 2. Construct Line 0-1 along the frontage of this project. 3. Comply with the acreage fee requirements for Drainage Area 44B as adopted by the Board of Supervisors. 4. Convey to the County, by offer of dedication, 10 feet of additional right of way on Oak Road As required for the planned future width of 100 feet. 5. Construct curb, 10-foot sidewalk (width measured from curb face), necessary longitudinal and transverse drainage, pavement widenin and a half-width median island (including surface treatment? on Oak Road. The face of curb shall be located 10 feet from the widened right of way line. 6. Install street lights on Oak Road. The final number and location of the lights will be determined by the utility company and approved by the Traffic Engineer. 7. Relinquish abutter' s rights of access along Oak Road with the exception of one driveway as approved by the Public Works Department. B. This project will be required to mitigate its cumulative impacts at the final development plan stage by participating in road and drainage improvements equivalent to $1,990 per unit (includes 25¢/square foot transit fee) . The cost of the Oak Road frontage improvements and Line D-1 of Drainage Area 44-B may be credited against this obligation. 00 151 C� � L�- CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3055-83: 1. Development shall be as shown on the revised plans submitted dated by the Planning Department March 14, 1984, subject to final review and approval by the County Zoning Administrator prior to the issuance of a building permit and subject to the conditions listed below. 2. Comply with the landscpae and irrigation requirements, as follows: A. Prior to issuance of a building permit, a landscape and irrigation plan shall be submitted for review and approval by the County Zoning Administrator. A cost estimate or copy of contract for landscaping improvements shall be submitted with the plan. Landscaping and irrigation shall be installed prior to occupancy. B. The required landscaping plan shall include intensive plantings adjacent to side property lines. Use of fast growing specimen sized trees shall be used where necessary to insure privacy. C. Landscaping shall be mounded along the Oak Rd. frontage and shall include the use of 15 gal. scarlet oaks planted at approkimately 20' intervals. D. The final landscape plan shall indicate locations of and landscaping around all utility meters, transformers, trash enclosures, etc. E. Where possible landscaping within the parking area shall be similarly located on both sides of the driveway within the driveway narrowed to 20' and shall incorporate canopy trees. F. Special attention shall be given to landscaping at the entry drive. 3. In conjunction with the landscaping and irrigation plan required above, the applicant shall submit perimeter pool area fencing design. 4. The proposed building elevations shall be similar to that shown on the submiited plans. Prior to the issuance of a building permit, elevations and architectural design of the building shall be subject to the final review and approval by the County Zoning Administrator. The roofs and exterior walls of the buildings shall be free of such objects as air conditioning or utility equipment, television aerials, etc., or screened from view. The final building plans shall include: a. . Adequate architectural treatment to create interest on the end wall facing Oak Road shall be provided. Windows shall be incorporated into the design. b. The exterior storage areas shall be designed to be architecturally "grounded" and not appear as the upper levels are "floating". c. Exteriors shall be earthtones. d. The applicant will provide adequate house numbering for each unit which is visible both day and night. 00 1� ���n�7 1107 Page 2 e. Adequate trim detail shall be incorporated into the design to camofloge the the ti siding joints. S. The trash enclosure located at the corner of the "S" in the driveway shall be relocated to behind the northerly carports. 6. A stop sign shall be placed at the driveway exit. 7. Exterior lights shall be deflected so that lights shine onto applicants property and not toward adjacent properties. 8. There may be one sign allowed for project identification purposes only permitted subject to the review and approval of the Zoning Administrator. The sign may be located within the landscaped setback area of the front property line. 9. The applicant shall provide 119 parking spaces on-site. 81 covered spaces shall be individually assigned to units. A minimum of 21 guest spaces shall be provided and clearly marked and maintained for short term guest usage. The applicant shall investigate and report to the County Zoning Administrator concepts available to sell extra spaces and/or discourage multiple car owner buyers. 10. The applicant shall request of the County Public Works Department permission to install "no parking between 9-11" signs along the Oak Road frontage. If this is granted 9 of the required guest spaces may be curb-side. 11. The carport supports shall be located at least 2' back from the carport cover. 12. No recreational vehicles shall be parked on site. 13. Comply with the Public Works Department as attached. 14. The applicant shall grant access rights to the abutting property to the south with such easement right being triggered upon development of that property for multiple family residential use and reciprocal easement rights granted to the subject property. The following comments are not conditions of approval but are provided for informational purposes. 1. The project site is within the CCCSD boundaries, and sewers have been planned for this area. An 8-inch public sewer must be extended to serve each parcel (residential or commercial lot, townhouse unit, condominium building, or apartment complex as appropriate) to provide gravity service. A 10-foot exclusive public sewer easement must be established over the alignment of any public main not located within a public road to provide access for future maintenance. 2. Water supply serving the properties concerned shall be by the Contra Costa County Water District. Such water distribution system located within the boundaries of the properties concerned in this Rezoning Application and Development Plan should become an integral part of the Contra Costa County Water District's overall water distribution system. We strongly recommend that each individual living unit be 00 153 Page 3 served by a separate water connection. It is our opinion that separate water connections would help prevent disruptions in service in individual living units. 3. Please be advised that the Department of Health Services-Environmental Health's approval of plans is required for any proposed pool or spa pool or swimmer's restrooms, shower or dressing facilities prior to construction or installation. The applicant should contact this department if he has any questions. Proceeding without obtaining the Department of Health Services-Environmental Health's approval can result in a financial penalty. 4. The developer shall submit two (2) complete sets of glans and specifications of the subject project to the Contra Costa County Consolidated Fire District for review and approval prior to construction to insure compliance with minimum requirements related to fire and life safety. The developer will be required to provide an adequate and reliable water supply for fire protection with a minimum fire flow of 3,250 GPM. Required fire flow shall be delivered from not more than four (4) hydrants flowing simultaneously while maintaining 20 pounds residual pressure in the main. Prior to combustible construction, the developer shall provide one (1) hydrant of the East Bay type. DE:ed7a 00 154 CONDITIONS FOR APPROVAL OF DP 3055-83 (PUBLIC WORKS DEPARTMENT) (Revised March 23, 1984) A. Unless exceptions are specifically granted, comply with the requirements of Division 1006 (Road Dedication and Setbacks) of the County Ordinance Code. This includes the following: 1. Convey to the County, by offer of dedication, 10 feet of additional right of way on Oak Road as required for the planned future width of 100 feet in accordance with County Drawing PA 4054-71. 2. Construct curb, 10-foot sidewalk (width measured from curb face), necessary longitudinal and transverse drainage, pavement widening and a median island (including surface treatment) on Oak Road. The face of curb shall be located 10 feet from the widened right of way line. 3. Install street lights on Oak Road. The final number and location of the lights will be determined by the utility company and approved by the Traffic Engineer. 4. Relinquish abutter's rights of access along Oak Road with the exception of one driveway as shown on the Development Plan B. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance and supplemented as follows: 1. Collect and convey storm waters from this project via Line D-1 of Drainage Area 44B. 2. Construct Line D-1 along the frontage of this project. C. Comply with the acreage fee requirements for Drainage Area 44B as adopted by the Board of Supervisors. The cost of constructing Line D-1 may be credited toward the applicant's drainage fee obligation. Costs is excess of this development's drainage fee obligation are partially reimbursable through a reimbursement agreement with the Flood Control District. D. Construct the interior roadways to minimum County private road standards. E. Prior to the issuance of any building permits, mitigate the cumulative impacts from this development by participating in offsite improvements equivalent to $1,990 per unit. The cost of the Oak Road frontage improvements, construction of Line D-1 of Drainage Area 44-B and drainage and transit fees may be applied to this obligation. The County shall have the flexibility to allocate these resources to road and drainage projects on a priority basis. 00 155 F. Furnish proof to the Public Works Department, Land Development Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. G. Submit site grading and drainage plans to the Public Works Depart- ment, Land Development Division, for review and approval prior to the issuance of any building permit or the construction of site improve- ments. H. Install all new utility distribution services underground. I. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Land Development Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signing and striping plans for review by the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Land Development Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Department. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post the bonds required by the agreement to guarantee completion of the work. J. Obtain an encroachment permit from the Public Works Department, Land Development Division, for construction of driveways or other improvements within the right of way of Oak Road.
