SUBJECT: Appeal by Mr. Ellis Patterson for Exoneration of Deferred Improvement Agreement
on Minor Subdivision 196-78

RECOMMENDATION
1. Acknowledge receipt of letter from Mr. Ellis Patterson, dated March 28, 1984, requesting
exoneration of deferred improvement agreement on Minor Subdivision 196-78 in the
Oakley area. Attached to the letter is a report from Oakley Municipal Advisory Council
dated February 27, 1984, recommending exoneration of the entire agreement.
2. Approve the request of Mr. Patterson to exonerate the agreement in its entirety. .
BACKGROUND
On April 10, 1984, by Item 2. 10 CORRESPONDENCE, the letter from Mr. Ellis Patterson and
Oakley Municipal Advisory Council was referred to the Public Works Director.
In 1978 Mr. Patterson subdivided a 5.8 acre lot into two parcels. The lot fronts .1.99
feet on the west side of State Highway 4 approximately 660 feet north of Laurel Road in
the Oakley area. The subdivision was to sell off the back lot and Mr. Patterson and his
wife have continued to reside on the parcel fronting State Highway 4.
As one of the Public Works Departments conditions of approval , the applicant was required
to dedicate the necessary additional 27.5 feet of right of way for the planned future
width of 100 feet for State Highway 4. The applicant was further required to execute
a Deferred Improvement Agreement for the necessary ultimate frontage improvements along
the entire State Highway 4 frontage. This consists of 26 feet by 199 feet (5174 ftl)
of additional payment widening and construction of curb, gutter, and sidewalk and necessary
longitudinal drainage.
The Public Works Department has reviewed conditions placed on other subdivisions along
State Highway 4 in the vicinity of Mr. Patterson' s property. Three fairly large subdivisions
in the vicinity were required to widen State Highway 4 an additional 6 feet for an interim
width only. Several other minor subdivisions were only required to dedicate the necessary
extra right of way as they were not developing to ultimate density. Other minor subdivisions
were required to execute Deferred Improvement Agreements for full frontage improvements
but they differed from Mr. Patterson's in that they were for commercial zoning.
