SUBJECT: Legislation: AB 2260 and SB 1344
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for AB 2260 (Harris) and SB 1344 (Davis),
BACKGROUND:
Existing law requires the Attorney General to take all appropriate action to enforce
a citation issued by the State Department of Health Services whenever a long-term
health care facility notifies the Director of the State Department of Health Services
that,it intends to contest the citatton. Current law also requires the Attorney
General to take all appropriate actions in the Superior Court to recover the civil
penalties resulting from the citation.
AB 2260 and SB 1344 would include the Director, State Department of Health Services,
in the requirement to take all appropriate actions to enforce the citation to
recover the civil penalties and would provide that the action be taken in a court
of competent jurisdiction rather than a Superior Court. This change would allow
the State Department of Health Services to file actions in Small Claims court
when the amount of the civil penalty is under $1500, and would allow the Attorney
General to file actions in municipal court when the amount does not exceed $15,000.
This should speed up decisions to enforce civil penalties and should, therefore,
be supported by the Board of Supervisors.
