Dixon, Interim County Administrator Contra Costa DATE: March 14, 1984 County SUBJECT: Legislation: AB 2257 and SB 1345 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt a position of support for AB 2257 (Agnos) and SB 1345 (Seymour) BACKGROUND: AB 2257 would permit a person filing a complaint with the State Department of Health Services to request an informal conference i'f the person filing the complaint is dissatisfied with the results• of the initial investigation into their complaint. In addition, the person filing the complaint would be authorized to attend an informal conference called at the request of a long-term health care facility whenever the facility protests the imposition of a civil penalty as a result of the complaint filed by the individual . The Office of the State Long-Term Care Ombudsman, and other specified organizations, would also be authorized to attend the informal conference. AB 2257 would also require the State Departments of Social Services and Health Services to provide the Office of the State Long-Term Care Ombudsman with copies of inspection reports on licensed facilities. The bill would also authorize the Office of the State Long-Term Care Ombudsman to undertake certain specified visitation, education, and training programs. Finally, the bill would increase the civil penalties for discrimination or retaliation against a patient or employee who files a complaint or grievance from $500 to not less than $1000, and not to exceed $5000. SB 1345 is identical to AB 2257 except that it does not include the increased civil penalties. To the extent that these bills increase citizen participation in the review of complaints they have filed, and increased penalties for taking action against people who file complaints, the bills appear consistent with the general direction the Board of Supervisors has taken on nursing home care and should, therefore, be supported by the Board.
