SUBJECT: SUPPORT OF LEGISLATION TO CONTINUE AUTHORITY FOR COUNTIES
TO OPERATE MISDEMEANOR PRETRIAL DIVERSION PROGRAMS
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Support SB 1709, introduced by Senator Ed Davis, which removes the January 1, 1985 sunset
in current law authorizing counties to operate Pretrial Misdemeanor Diversion Programs and
provides for the imposition of an administrative fee.
BACKGROUND:
California Penal Code Sections 1001 through 1001.11 authorize the District Attorney to operate
Misdemeanor Pretrial Diversion Programs. Section 1001.11 contains a sunset clause with
respect to this authorization of January 1, 1985. In addition, there is no provision for
collection of an administrative fee from the defendant. ,
The proposed legislation would remove the sunset clause, thus making the authorization to
operate such programs permanent, and would permit the imposition of an administrative fee.
The District Attorney's Office currently operates an Adult Pretrial Diversion Program which
has been very useful in diverting minor offenders from the court system, thus freeing up
valuable court and prosecutorial time for major cases. Proposed legislation would permit
this program to continue beyond January 1, 1985, and by providing for an administrative fee,
may generate some revenue to help offset the cost of the program.
The District Attorney supports this legislation.
