RECOMMENDATION
1. Authorize the Public Works Director to chip seal Briones Valley Road fronting Subdivisions
MS 100-79 and MS 108-79, contingent on the owners paying $1.6,100 to the County prior
to August 1, 1984, and providing that owners perform site preparation work.
2. Declare the Board' s intent to exonerate the Deferred Improvement Agreements after
work is complete.
BACKGROUND
The Board, on October 18, 1983, referred to the Director of Planning and the Public Works
Director a petition requesting reconsideration of the Public Works Department 's decision
to activate Deferred Improvement Agreements for Subdivisions MS 100-79 and 108-79. These
agreements require that owners construct permanent improvements along Briones Valley Road,
including asphalt paving.
On April 18, 1983, Subdivision MS 3-83 was approved. A condition of approval required
the construction of frontage improvements along Briones Valley Road, contingent upon the
Public Works Director notifying property owners that the frontage improvement required
by the Deferred Improvement Agreements must be constructed. On June 14, 1983, these notices
were sent to the current owners.
Since the October 18, 1983 Board referral, the owners of all eight parcels concerned have
agreed to an alternate proposal , with the concurrence of the Public Works Director. The
alternate proposal calls for the owners to pay to the County a fixed, agreed upon amount
of $16,100 (15,333.3 square yards-at $1.05 per square yard) with the Public Works Department's
Maintenance Division constructing a triple chip seal on Briones Valley Road.
Site preparation will be the responsibility of the property owners. Work would be done
in conjunction with Maintenance Division chip seal operations in the area. This is scheduled
for the last part of August, 1984.
If this alternate proposal is approved, the Public Works Directo recommends that the
Board exonerate the Deferred Improvements after chip seal ork is com ete.
