THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY. CALIFORNIA AdopW V& Order on April 17, 1984 .by 1ollowng vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson NOES: None ABSENT: Supervisor Schroder ABSTAIN: None SUBJECT: Sale of Surplus Property on Rule Court, Walnut Creek The Chair noted that he had received requests to speak on Agenda Items 1.1 and 1.2 of the Consent Calendar relating to the sale of surplus real property on Rule Court in the Walnut Creek area to LaVonne H. McDonald, Kern Schumacher and Joy N. Pritchard. The Public Works Director explained that the surplus real property was a vacated right of way on Rule Court and there appeared to be a dispute between the adjacent landowners as to where the property line is to be drawn. The following persons appeared in favor of the proposed sale as recommended by the Public Works Director: Janice Titmus, 1211 Newell Avenue, Oakland, representing Dr. Aguilar who uses the subject property for parking spaces for his patients; and Mel Pritchard, P.O. Box 454, Carmel Valley, representing Joy Pritchard and Kern Schumacher. The following appeared in opposition to the proposed sale: Michael Young, 100 Mission Street, San Francisco, attorney for LaVonne H. McDonald and Western Title Insurance Co. , who requested the matter be removed from the Calendar until the issue of fee title can be resolved. County County commented that the County was merely proposing to quitclaim whatever interest it has, if any, by quitclaim deed, and was not proposing to resolve title issues, if there are any, and would agree to amend the proposed quitclaim deed to indicate that the County is not making repre- sentation that it has any interest. The Board after considering the testimony presented this day, hereby DECLARES its intent to approve the proposed sale of surplus property on Rule Court, and DIRECTS County Counsel to review wording for inclusion in the quit- claim deeds, and DEFERS to April 24, 1984 action on the recommendation of Public Works Director to approve the sale of said surplus property.
