SUBJECT: Legislation: SB 1440 (Torres & McCorquodale)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in opposition to SB 1440.
BACKGROUND:
This County's current personnel rules provide for a fairly extensive appeal and
grievance procedure including the use of an independent third party mediator.
SB 1440, introduced by Senators Torres and McCorquodale, would, in addition, give
the State Public Employment Relations Board and the superior courts concurrent
initial jurisdiction over alleged unfair labor practices. Currently, the PERB has
Jurisdiction only over public school employees, state civil service employees,
and higher education employees. Extending PERB's jurisdiction to counties and other
agencies of local government when adequate appeals and mediation processes are
already in place appears to be wasteful and an unwarranted intrusion on local
government.
The Director of Personnel recommends that the Board oppose SB 1440. We concur with
that recommendation. SB 1440 is scheduled to be heard in the Senate Governmental
Organization Committee on April 10, 1984.
