SUBJECT: Hearing on appeal of Raymond Zaharis from Board of
Appeals decision of application of Peter and Ann
Whi-tehead to establish a school (LUP 2110-83 with
dimensional parking variance) in the San Ramon area.
The Board on February 21, 1984, having continued to this
date the hearing on the appeal of Raymond Zaharis from Board of
Appeals decision of application of Peter and Ann Whitehead to
establish a school, LUP 2110-83 with dimensional parking variance,
in the San Ramon area; and
Harvey Bragdon, Assistant Director of Planning having
described the property as being located on the east side of Bollinger
Canyon Road in the San Ramon area, and having advised that the San
Ramon Valley Area Planning Commission has allowed the use of this
property for a school with an ultimate population of 90 students;
and
Supervisor Schroder having inquired as to whether there I
was a condition to attach the sewer to the property; and

Harvey Bragdon, having stated that the Health Department I
had advised that the number of students could be accommodated with
the existing septic tank; and I
Peter Whitehead, applicant, having appeared and having
stated that the school facility in San Ramon presently had a license
for 59 students and hoped to increase to 90 students ranging in ages
from 18 months to 10 years, and having then addressed some of the
concerns relating to traffic, the vegetation, and the septic tank
and advised that the road leading to the school facility had been f
widened, the vegetation had been cleared and a stop sign had been
ordered for the road serving the school so that traffic leaving the
school would be required to stop before entering Bollinger Canyon
Road; and
Ray Zaharis, appellant, having appeared and expressed his
concerns about traffic on Bollinger Canyon Road, and having also
submitted a petition to the Board with 31 signatures, requesting
that LUP 2110-83 be held over until the issues of traffic and the
septic tank requirements had been addressed; and
Peter Whitehead having appeared in rebuttal and having
stated that the school facility would not create peak hour traffic
problems nor conflict with existing traffic on Bollinger Canyon
Road; and
Ann Whitehead, having also appeared in rebuttal, and
having stated that the septic tank would not be used 24 hours a day
as would a single family residence with a family living in it, and
having also stated that 90 children were the maximum number of
children that would be allowed at the school at any one time,
and that several children would be attending school only on a part-
time basis; and
and The Chairman having declared the public hearing closed;

Supervisor Schroder having advised that it was his inten-
tion, after reading the staff report and reviewing the San Ramon
Valley Area Planning Commission' s determinations, to approve the
application and to deny the appeal, but stated that he would like to
defer action on this matter for at least one week, in order to
determine what area traffic engineer had in mind for appropriate
traffic improvements, and also having stated that he would like to
personally see the entrance road *for the school facility; and
Supervisor Torlakson, having inquired as to whether there
had been any discussion with the applicants with respect to
installing a road sign such as "slow school entrance" ; and
Boyd D. Jewett, Assistant Public Works Director, Land
Development Division, stated that the County Public Works Department
has recommended that a California road sign be placed 400 to 500
feet southerly of the entrance and that a arterial stop sign be
placed 'at the' bottom of the driveway for the cars entering Bollinger
Canyon Road;
Board members having discussed the matter, IT IS ORDERED
that its DECISION on the appeal of Raymond Zaharis from Board of
Appeals approval of the application of Peter and Ann Whitehead
(LUP 2110-83) is DEFERRED to March 13, 1984, at 9: 00 a.m.

At 3:48 p.m. the Board recessed to meet in Closed
Session in Room 105, County Administration Building, Martinez,
California, to discuss personnel matters.
At 5:00 p.m. the Board reconvened in its Chambers and
immediately adjourned to meet in Regular Session on Tuesday,
March 13 , 1984 at 9 a.m. in the Board Chambers, Room 107, County
Administration Building, Martinez, CA.
