SUBJECT: Report on Fish and Game Permit Requirements for Wildcat Creek Project.

RECOMMENDATION
Acknowledge receipt of report.
BACKGROUND
As a part of the permitting process for the emergency project on Wildcat Creek completed
last fall, the Flood Control District had to obtain a permit from the State Department
of Fish and Game. One of the requirements of the permit was that the District would take
steps to retain the low flows going down the existing creek as opposed to the new interim
by-pass channel . During construction, against our better judgment, the District placed
an earth berm, . as suggested by the Fish and Game staff, to accomplish the objective.
The berm has since failed. On February 22, 1984 Milton Kubicek met with representatives
of the Fish and Game Department at the project site. It was agreed that the critical
time with regard to the low flows and fish migration was the latter part of March and
the month of April. It was also agreed that the Flood Control District would construct,
prior to March 14, 1984, a barrier approximately 600 feet downstream of First Street,
to effect the redirection of the low flows down the existing creek bed.
