Waters) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt a position in opposition to AB 2452 by Assemblywoman: Maxine Waters. BACKGROUND: AB 2452 would make it a misdemeanor for an employer to adopt any rule, or to retaliate against an employee who discloses information to a government agency or law enforce- ment agency where the employee has reasonable cause to believe that the information discloses a violation of State or Federal law. ' The Director of Personnel is concerned that this bill is drafted in such a. way as to allow the individual employee to decide whether he or she has "reasonable cause" to believe that such a violation has occurred. Such open-ended language can cause substantially increased litigation and arguments between employees and employers on whether the employee had "reasonable cause". If the bill were amended to define or limit "reasonable cause", we would be more inclined to recommend that it be supported. In the absence of such a definition, the Director of Personnel recommends that the Board oppose AB 2452.
