RECOMMENDATION:1
Support SB 1576;, introduced by Senator Daniel Boatwright, and AB 2444, introduced by
Assemblyman Dan Hauser, (provided the latter bill is amended to conform to SB 1576) with
respect to authorizing the County Board of Parole Commissioners to collect from the prisoner'
granted parole costs applicable to the administration of that prisoner's parole program.
BACKGROUND:
The California Penal Code authorizes the establishment of a County Board of Parole Commis-
sioners consisting of the Sheriff, County Probation Officer and a public member. This
Board has authority, under specified circumstances, to grant county parole to those adult
sentenced prisoners confined in county jail. The law does not currently permit the County
to recover the cost of operating such a program.
As you know, we have been attempting, as part of our overall detention facility and correction
planning, to expand to the extent possible alternatives to incarceration. County parole is
one of those programs that is in the process of expansion. For example, in calendar year
1982, there were 13 grants of county parole; in 1983, there were 48. Senator Boatwright's
bill, SB 1576, would remedy this current omission of law and permit the County Board of
Parole Commissioners to collect from the prisoner, according to ability to pay, the cost
of the administration of that prisoner's parole program. Basically, these costs fall into
the areas of (1) pre-parole investigation conducted by Sheriff's Department personnel, and
(2) parole supervision, usually provided by the Probation Department. Assemblyman Hauser's
bill currently contains more complex procedures for cost recovery, but he has indicated he
is willing to amend his bill to conform to SB 1576.
While it is not anticipated this would generate a great amount of revenue, it does give
this County the authority to collect; and with the recent increase in the number of paroles
granted, any additional revenue will, of course, be useful in supporting the program.
Both the Sheriff and the County Probation Officer support the above recommendation.
