THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on March 27, 1984 _, by the following vote:
AYES: Supervisors Powers, Schroder , Torlakson
NOES: None
ABSENT: Supervisors Fanden, McPeak
ABSTAIN: None
SUBJECT: Hearing on appeal of Hillis H. Schlak from granting of
Variance Application #1081-83, (Gregory and Gayle Jones,
owners) to establish a zero-foot sideyard for a retaining
wall in the Walnut Creek area.
This being the time fixed for hearing on the appeal of
Hillis H. Schlak from granting of Variance Application #1081-83,
(Gregory and Gayle Jones, owners) to establish a zero-foot sideyard
for a retaining wall in the Walnut Creek area; and
Harvey Bragdon, Assistant Director of Planning having
described the project as being a variance to establish a zero-foot
sideyard for a retaining wall, and advised that the recommendation of
the County Planning Commission was to approve Variance Application
#1081-83; and
Gregory Jones, 2499 Warren Road, Walnut Creek, having
appeared and briefly described the circumstances which required the
filing of Variance Application #1081-83 to establish a zero-foot
sideyard for a retaining wall, and having urged the Board to approve
the Variance Application by denying the appeal of Hillis H. Schlak;
and
Hillis H. Schlak, 2497 Warren Road, Walnut Creek, having
appeared and urged the Board to change the conditions of Variance
Application #1081-83, and having expressed his objections to the
construction of the retaining wall which he felt had not been
constructed in compliance with the plans which were submitted to the
County; and
Mr . Schlak having also voiced concerns relating to
drainage problems on the subject property, and having requested that
the Board require that conditions of Variance Application #1081-83
be complied with, and also having requested that the Board add one
additional condition which would require the restoration of the
sideyard property line to its original state, and Mr . Schlak also
stated that he had some concerns regarding the enforcement of the
conditions of approval for the variance application; and
Supervisor Powers having recommended that the issues of
enforcement be referred to the Director of Building Inspection, and
also having commented that in his opinion, he had not yet heard any
testimony as to why the variance application should not be
granted; and
Paul Siedelman, engineer representing Gregory Jones, having
appeared in rebuttal and having stated that the major problem with
reference to this variance application was in determining where to
stop the construction of the retaining wall so as to prevent any
further land slides; and
The Chairman having closed the public hearing; and
Supervisor Schroder having commented that he was not opposed
to the action of the Zoning Administrator regarding this variance
application, and having requested that the Board defer its decision on
this matter for two weeks in order to allow adequate time to work on
this situation in the hopes that both parties will benefit from the
Boards final decision;
Board members having discussed the matter , IT IS ORDERED
that the decision on the appeal of Variance Application #1081-83 is
DEFERRED to April 10, 1984, at 2: 30 p.m. , and the issues of enfor-
cement of the conditions of Variance Application #1081-83 are REFERRED
to the Director of Building Inspection.
