SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in support of Senate Constitutional Amendment No. 54.
BACKGROUND:
Existing constitutional law limits ad valorem property taxes on real estate to 1%
of the full cash value of the property, except for property taxes to pay the
interest and redemption charges on indebtedness approved by the voters prior to
July 1 , 1978. There is no provision in the Constitution to also allow for an
exception to this limitation for the payment of interest and redemption charges
on bonded indebtedness approved by the voters subsequent to July 1 , 1978,
SCA 54 would provide such an exception for bonded indebtedness for the acquisition
or improvement of real property if the indebtedness is approved by 2/3 of the
voters voting on the proposition. To the extent that SCA 54 would allow a Board
of Supervisors to place such a proposition on the ballot for decision by the voters,
it provides counties more flexibility and local control in managing their fiscal
affairs and deserves the support of the Board of Supervisors.
SCA 54 is set for hearing in the Senate Revenue & Taxation Committee on April 4,
1984.
