MICHAEL WALFORD, PUBLIC WORKS DIRECTOR Cur ty DATE: March 13, 1984 Cour SUBJECT: Viacom Cablevision's Request for a Franchise Renewal Specific Requests or Reci ndation s b Background b Justification RECOMMENDATION .It is the recommendation of the Public Works Director that Viacom's request for a CATV franchise renewal be granted, subject to the terms and conditions of County Ordinance 82-28. BACKGROUND On January 17, 1984. the Board of Supervisors referred to the Public Works Department Viacom Cablevision's request for a franchise renewal to provide cable television services to the Crockett-Rodeo, El Sobrante and San Pablo areas of western Contra Costa County. The request for renewal was submitted pursuant to provisions of the County' s CATV Ordinance No. 82-28. The County upon receipt of the renewal has four months to review the proposal and either recommend renewal or deny the request in keeping with the County's Ordinance. The two licensed areas of Crockett-Rodeo and E1 Sobrante and San Pablo, are a part of Viacom's Pinole system. The license history for these two areas dates back -1966. A license was granted to Contra Costa Cable Company in 1966 for the area known as Crockett. Subse- quently, in 1967 the El Sobrante area was assigned to this license through an amendment and in December 1967 the Rodeo area was assigned to the Contra Costa Cable Company system. The licenses granted were for a 20 year term. Viacom is currently seeking a renewal of their franchise for this area pursuant to Ordinance 82-28 for a 15 year term. The channel lineup and rate schedule for Viacom' s proposal are attached to this report. It should be noted that Viacom is offering a subscriber discount of 20 percent to subscribers who are 65 years old who are receiving SSI/SSP payments and who are heads of households as defined by the IRS. In evaluating Viacom's proposal, County Ordinance requires that a CATV system shall have the minimum channel capacity of 26 channels available for immediate use. Viacom meets and exceeds this requirement with a 30 channel system. It is Viacom' s intent to provide 18 channels in the basic tier, 7 channels in the deluxe tier and 5 premium services. It should be noted that pursuant to the County Ordinance and recent FCC rulings, the County only has jurisdiction to regulate the price of basic service and certain service levels excluding program content. At such time as Viacom installs within their system fully addressable Zenith converters, the pricing structure will change. The basic level of service will be reduced by 50 cents to $8.50 and the deluxe service will be provided for $1.50. Until such time as Viacom has the technology to separate the basic and deluxe services, they will be offered for a combined price of $10.00. Viacom' s proposal is in accordance with _the- County's Ordinance in regard to performance specifications; likewise, the affirmative action plan incorporated within Viacom's proposal meets the requirements of the County Ordinance. It should be further noted that the pricing structure and channel alignment as presented in this propa�al is the same as that for the Ciole.
