SUBJECT: Organizational Placement of Clerk of the Board
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
Recommendation
It is recommended that the Board introduce an ordinance which will
allow the Board of Supervisors to appoint the Clerk of the Board, waive
reading of the ordinance, and set March 20, 1984 , for second reading and
adoption.
Background
The function of the Clerk of the Board operates as a ,division of the
Office of County Clerk-Recorder. The office provides staff support to
the Board of Supervisors by maintaining all official records and preparing
and distributing the agenda and minutes of all Board meetings. The Clerk
also provides staff to the Assessment Appeals Board, maintains rosters
of county commissions and advisory boards and publishes legal notices.
Government Code Section 25100. 5 provides an organizational option
allowing the Board by ordinance to provide for the appointment of its own
clerk, thus separating the function from the County Clerk. The Attorney
General has opined that this separation may occur during the County Clerk' s
elected term of office.
In light of the retirement of Geraldine J. Russell, who serves as
Chief Clerk in the Office of the Clerk of the Board, it seems an opportune
time to consider transferring this '.function. It is our recommendation
that the Board take such action and subsequently appoint the County
Administrator as Clerk of the Board. The County Administrator would then
appoint the Chief Clerk to replace Mrs. Russell.
We have surveyed all other counties in the State and find that in
33 of the 58 counties the Clerk is not appointed by the County Clerk. It
is our view that the day-to-day working relationship of the Clerk of the
Board and the Office of the County Administrator is substantial. The agenda
is a joint product of the two offices and much of the responsibility for
preparing board orders and committee reports is also shared. Joint adminis-
tration would allow temporary adjustments in personnel and a smoother flow
of paperwork.
