HomeMy WebLinkAboutMINUTES - 03131984 - 2.14 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 13, 1984 , by the following vote: AYES: Supervisors Powers, Fanden, Schroder , McPeak, Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Decision on Appeal of Raymond Zaharis from Board of Appeals decision of application of Peter and Ann Whitehead to establish a school, (LUP 2110-83 with dimensional parking variance) , in the San Ramon area. The Board on March 6, 1984, having closed the public hearing, and deferred decision to this date on the appeal of Raymond Zaharis from Board of Appeals decision of application of Peter and Ann Whitehead (LUP 2110-83) to establish a school in the San Ramon area; and Supervisor Schroder having commented that he had visited the site and after having conferred with the Public Works and Planning Departments, he was convinced that the conditions placed on LUP 2110-83 were adequate, and having therefore recommended that the Board deny the appeal and approve the application for (LUP 2110-83) ; Board members having considered the matter, IT IS ORDERED that the appeal of Raymond Zaharis from Board of Appeals approval is DENIED and the application of Peter and Ann Whitehead for (LUP 2110-83) is APPROVED subject to the conditions of approval as set forth by the San Ramon Valley Area Planning Commission, Exhibit A attached hereto and by reference incorporated herein. hereby certify that this is a true and cotnectoopyof an action taken and entered on the minutes of the Board of Supervisorsonthe date shown. Development shall be as shown on the revised plans submitted to the Planning Department dated December 9, 1983. 2. The permit is issued to the applicant/owner, Ann Whitehead only, and shall not be transferred. 3. The permit is valid for a period of 18 months, at which time it shall be reviewed and subject to administrative approval. 4. The maximum attendance of the Child Day School at any one time shall be limited to 60 children. The enrollment can be expanded to 90 children subject to appropriate State licensing requirements, and administrative review by the Zoning Administrator. S. The hours of operation of the school shall be from 7:00 a.m. to 6:00 p.m., Monday through Friday. 6. No loudspeakers or amplified music shall be prmitted outside the enclosed building. 7. The driveway width immediately in front of the structure shall have a minimum width of 24 feet of pavement. 8. All signs are subject to review and approval of the Zoning Administrator. 9. Comply with the requirements of the Public Works Department as follows: A. Prior to the issuance of any building permits, execute a deferred improvement agreement with the County requiring the owners of the property involved with LUP 2110-83 to: 1. Construct approximately 7 feet of pavement widening and necessary longitudinal and transverse drainage along the frontage of Bollinger Canyon Road. 2. Submit improvement plans to the Public Works Department, Land Development Division for review and pay the inspection and plan review fees. B. Prior to the issuance of any building permits, relinquish abutter's rights of access along Bollinger Canyon Road with the exception of the access road. C. The above instrument(s) will be prepared by the Public Works Department, Land Development Division, upon request by the applicant and submittal of a current title report on the affected property. D. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance. 2110-83 pg. 2 E. Furnish proof to the Public Works Department, Land Development Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements.
