Specific Requests or Recommendat-Tio-n-FsT & Background & Justification RECOMMENDATION Refer to the Finance Committee for recommendation on: 1. Future funding for maintenance of flood control improvements in Flood Control Zones 29 69 99 11, and Storm Drain Maintenance District No. 1. 2. Allocation of $40,000 in special District Augmentation Funds to Flood Control Zone 9 for current fiscal year maintenance and storm damage repairs. . BACKGROUND Five Flood Control entities have, or will shortly have, a maintenance responsibility and no financial means of meeting the obligation. Three of the entities, Flood Control Zones 2 and 9 and Storm Drain Maintenance District No. 1, had a zero tax rate in the year Proposition 13 was enacted. Immediately prior to the passage of Proposition 13 these entities had sufficient carry-over funds for the forthcoming year. Consequently, being responsive to the tax payers' desires for lower taxes, the Board set a zero tax rate. Unfortunately, this resulted in a permanent zero share of the one percent property tax. Two of these entities have current maintenance responsibilities, i .e. Flood Control Zone 9 (Pinole) and Storm Drain Maintenance District No. 1 (Concord-Walnut Creek). Flood Control Zone 9 has maintained the Pinole Creek Corps of Engineers improvements for the past six years by using approximately $110,000 in capital improvement funds, which had been accumulated for a proposed upstream improvement project. These funds are now gone, and due to the past two severe winters the Zone 9 Fund now has a deficit balance of $38,000. The future Zone 9 annual maintenance costs are estimated to be $20,000, in 1984 dollars. This estimate is based on normal rain years. Storm Drain Maintenance District No. 1 is currently using capital improvement funds to meet its maintenance responsibility. The annual maintenance cost in this district is approximately $9,000, at 1984 prices. Flood Control Zone 2 (Kellogg Creek-Byron Area) presently has only a minor side channel detention facility to maintain. The other limited maintenance work performed in Kellogg Creek is funded under County Drainage Maintenance Fund 330. However, the United States Department of Agriculture, Soil Conser- vation Service, at the District's request, is developing plans for improving Kellogg Creek to reduce the frequency of flooding from the creek. If an acceptable plan is found and the improvements are implemented, the annual maintenance cost for the improved portion of Kellogg Creek will be between $8,000 and $10,000. To obtain the 100% federal funding for construction of the improvement, the Flood Control District or the County will have to assume future maintenance responsibility for the improvements. The remaining two entities, Flood Control Zone 6 (San Pablo Creek) and Flood Control Zone 11 (East Antioch Creek), currently do not have improvements to maintain. However, improvements are scheduled for construction in both entities in 1985 and 1984, respectively. The Flood Control Zone 6 improvement is the San Pablo Creek portion of the Corps of Engineers Wildcat-San Pablo Creek Improvement Project. This improvement is estimated to cost $9,600,000, and it is being funded by federal , state, and local assessment district. As outlined in the District's report for the project, the proposed drainage fee for the area upstream of the improvements has been adopted. However, the expected revenue from the fee will not provide sufficient or a steady enough income for financing the maintenance costs due to the fact that a substantial portion of the fee area is already urbanized and the fees are only paid as development occurs. The annual maintenance cost for the proposed improvements is estimated to be $30,000; after five years, one half of this cost can be covered by the expected drainage fees. The improvements in Zone 11 (East Antioch Creek ) to be maintained by the District consist of major and secondary channel improvements to be constructed over the next twenty years. These improvements, estimated to cost $10,600,000, are being installed through drainage fees. Due to the piecemeal construction, the annual maintenance cost will vary with the extent of improvements installed. The estimated annual maintenance cost for the completed system is $35,000. The minor storm drain pipe systems also being installed as a part of the plan will be maintained by the City of Antioch or the County. The attached Appendix A summarizes the amounts of additional funds needed by these entities to meet their respective annual maintenance costs. The immediate need is for $40,000 to eliminate the Flood Control Zone 9 deficit.
