Wi ngett, County Administrator Costa ('` DATE: March 8, 1984 lrl urly SUBJECT: Legislation: AB 4023 (Tanner) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt a position of support for AB 4023. BACKGROUND: Current law states that the residue of a pesticide chemical is not deemed unsafe if the pesticide chemical has been used. in or on a raw agriculatural commodity in conformity with an exemption or a tolerance prescribed under state law and the raw agricultural commodity has been subject to processing such as canning, cooking, freezing, dehydrating, or milling. AB 4023, which has been introduced by Assemblywoman Tanner and 35 other members of the Assembly, including three of our Assemblymen, would in regard to ethylene dibromide (EDB) provide that effective January 1 , 1985 acceptable levels of EDB are 10 parts per billion in foods that require heating before they are eaten and 2 parts per billion in foods that may be eaten without cooking. In addition, effective July 1 , 1985, AB 4023 would provide that any processed food containing any EDB would be considered adulterated. Finally, AB 4023 would, effective January 1 , 19859 consider any food intended for consumption by infants or children under the age of two adulterated if the food contains any EDB. AB 4023, as introduced, is essentially similar to the recommendation made to the Board by Wendel Brunner, M.D. , Assistant Health Services Director--Public Health, and we are, therefore, recommending that the Board support AB 4023.
