Sec. 8335) (WO 1667) The Board of Supervisors of Contra Costa County RESOLVES THAT: This vacation action is for the disposal of the County's interest in the surplus portion of Canal Alley, a 16-foot in width road right of way located in the Pacheco area. The vacation of said road right of way is made pursuant to the Streets and Highways Code Section 8331 and in compli- ance with the Planning Department Staff Recommendation for the conditions of approval for the permit application No. 2100-84. The County Planning Commission determined that the project is in conformance with the General Plan on November 13, 1984. For a description of the portion to be vacated, see Exhibit "A" attached hereto and incorporated herein by this reference. This Board hereby FINDS that the proposed vacation will not have a significant effect on the environment, and that it has been determined to be categorically exempt under State guidelines Section 15312 in compli- ance with the California Environmental Quality Act. The property does not have significant values for wildlife habitat or other environmental purposes and is of such size and shape that it is incapable of independent development or use. The Planning Department having filed its general plan report concerning this proposed vacation and this Board having considered the general plan, it finds pursuant to Government Code Sec. 65402(a) that: It has received the Planning Commission's report. This Board declares that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes a highway. This vacation is made under the Streets and Highways Code, Chapter 4, Sections 8330 et seq. The subject property has not been used for the purpose for which it was dedicated nor has it been passable for vehicular travel for a period of five years proceeding this vacation action. No public funds have been expended for maintenance on the subject property. The Public Works Director shall file with the County Clerk a Notice of Exemption concerning this vacation. 00 002 RESOLUTION NO. 84/689 RESOLUTION Nn_ Rd/FRQ Vacation No. 1926 Canal Alley EXHIBIT "A" Portion of Block 1 of the original survey of the Town of Pacheco shown on the map entitled "Map of Pacheco, Contra Costa County, California" filed in Book E of Maps at page 95, records of Contra Costa County, described as follows: A strip of land 16-foot in width running east from the east line of Pacheco Boulevard and terminating on the west side of State Highway Number 680. The southerly line of' said strip of land also being the northerly line of lot 4 and lot 68 as shown on said map, (E-M-95) and the northerly line of the parcel of land described in the "Abandoning of a portion of Canal Alley in the Pacheco Area," filed July 12, 1977, Book 8414 of Official Records at page 222, records of Contra Costa County. RESERVING THEREFROM, an easement for public sanitary service purposes, pursuant to the provisions of Section 8340 of the Streets and Highways Code, the easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers, and appurtenant structures in, upon, over and across any highway or part thereof proposed to be abandoned and pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, convenient structures, and for incidental purposes, including access to protect the property from all hazards in, upon and over the easterly 135 feet of said area hereinbefore described to abandoned.
