Adopted this Order on February 7 , 1984 by the following vote:
AYES: Supervisors Powers , Fanden, Schroder, McPeak, Torlakson
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Bay Conservation and Development Commission
Decision on Acme Landfill Expansion
Supervisor Tom Torlakson having referred to the
impending garbage crisis in Contra Costa County and the appli-
cation of Acme Landfill for a permit to expand its landfill
site; and
Supervisor Torlakson having referred to the recent
decision of the Bay Conservation and Development Commission
(BCDC) that the proposed Acme Landfill expansion is not consistent
with the Bay Plan; and
Supervisor Torlakson having also commented on the need
for approval of the compromise proposal presented to the Army
Corps of Engineers in order to provide adequate time to develop
alternate sanitary landfill sites, and having suggested that a
protest be registered with the Army Corps of Engineers on the
decision of BCDC; and
The Board being in agreement, IT IS ORDERED that the
Director of Planning is AUTHORIZED .to prepare for the Chairman's
signature a letter to Colonel Edward M. Lee, Jr. , District
Engineer , U. S. Army Corps of Engineers, protesting the decision
of BCDC and requesting a favorable decision on the compromise
proposal .

Dear Colonel Lee:
We have a garbage crisis. We were shocked at the BCDC decision finding
that the Acme Landfill Expansion is not consistent with the Bay Plan and
strongly disagree with it. We first do not believe that BCDC has the
authority to control development outside their area of permit jurisdiction.
Secondly, we do not agree with their assessment that the use of the sani-
tary landfill is not an "interiri land use preparatory for future use of
an industrial nature. Most important, we urge that you do not follow the
lead of BCDC and decide this issue on a technically inappropriate basis,
but instead that you use your good judgment to balance the important issues
affecting the general public.
As I clearly pointed out in my testimony to you and BCDC in behalf of Contra
Costa County, fifteen cities and the County Solid Waste Commission agree
with the Board of Supervisors that we have an impending garbage crisis. We
urge approval of the compromise proposal which you have before you. We need
adequate time to actually develop alternate sanitary landfill sites before
Acme is forced to close. Any site we choose, I 'm sure, will have some
environmental impacts and needs for mitigation. We should not rush such a
process either in defining these environmental mitigations or in reducing
the amount of time necessary for proper public input.
Again, please also appreciate that the taxpayers and rate payers in Contra
Costa County will suffer if a favorable decision is not rendered.
We note for the record that Supervisor Fanden did not speak for the Board
of Supervisors or Contra Costa County in her remarks and vote at the last
BCDC hearing.
Besides the very signifi.cant and easily demonstrable need for landfill site
capacity in the next few years, we must further emphasize that we do not

see any way of carrying the extra $2.0-4.5 million cost for disposal of
dredged material from the flood control maintenance of Walnut Creek.
Contra Costa County is in the midst of an extreme fiscal crisis. We cannot
bear such an additional burden in this or the next few years ahead.
The Board respectfully requests a meeting with you as soon as possible to
discuss the urgency of this matter and so authorizes me as Chairman of the
Board to meet with you at your earliest convenience.

SUBJECT: Explanation of the BCDC Decision on. the Acme Expansion
Application and Clarification of "Water-related .
Industry" Category
In its discussion on the Acme Landfill application,
Supervisor S . W. McPeak referred to the term "water-related
industry" used by the San Francisco Bay Conservation and
Development Commission (BCDC) and requested a definition of
that term.
Supervisor. T. Powers responded that in his opinion it
would apply to those industries that must have access to a
waterway or must have a valid reason for being situated
near a waterway.
Supervisor McPeak again referred to the expansion appli-
cation of Acme, and the concerns expressed by constituents
relative to sanitary landfill," wildlife habitats and sanc-
tuaries , the fact that the area in question is marshland , as
well as concerns over the quality of the water table and
preventing contamination of the aquifers . She noted that
all of these concerns could apply to any water-related
industry located along a waterfront and not to just the Acme
expansion project .
Board. members being in agreement , IT IS ORDERED that
the Director of Planning is REQUESTED to explain the BCDC
decision on the Acme landfill expansion project, particularly
as it relates to BCDC ' s designation of water-related industry,
and report to the Board on same .
