SUBJECT: Agreement for Legal Services in Connection with
Implementation of Pleasant Hill BART Station Specific Plan
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
AUTHORIZE Executive Director to negotiate an agreement with Dooley,
Anderson, Berg, Pardini, Johnson & Ziegler, Attorneys at Law, for legal
services in connection with implementation of the Pleasant Hill BART
Station Specific Plan.
BACKGROUND i
While BART is unable to participate in the initial financing of infra-
structure improvements for the subject project, BART will benefit greatly
from their completion. Completion of the infrastructure will make the BART
station ready for joint development by providing improved access, adequate
utilities, necessary drainage facilities, etc. While BART does not have
funds currently available to initially participate in the financing of the
infrastructure improvements, BART does have control of lands outside of the
BART station area proper that the County needs in order to construct area
road and drainage improvement and the Redevelopment Agency needs in order to
allow development to proceed in areas 10A, 10B, 8 and 9.
It is proposed that BART convey fee title to the properties outside of the
station area proper (Specific Plan areas 11 and 12) . Those properties
necessary for area road improvements would be conveyed at no charge and
without any credit against future development fees . As the Specific Plan
provides for BART to develop as much as two million square feet of office/
commercial development in the air space over the station, conveyance of this
property at no cost (dedication) is consistent with requirements placed on
other developers to dedicate property to public agencies for roadway purposes.
With respect to those properties conveyed that are outside of the station
area proper and outside of the areas necessary for roadway improvements
(plan areas 10A, 10B, 8 and 9) , credit would be given against future develop-
ment fees that BART (or its developer) would owe when the air space over the
station develops.
Specialized legal services are required to complete negotiations and reach
agreement with BART regarding the aforementioned properties and BART' s
participation in and contribution toward implementation of the Specific
Plan.
