SUBJECT: Legislation AB 2218. (baker)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in support of AD 2218.
BACKGROUND:
AB 2218 was introduced by Assemblyman Baker at the request of Contra Costa County.
Under existing law, a person issued a notice to appear or notice of violation under
the Vehicle Code may demand that the venue for appearance be the county seat or the
judicial district in Which the offense is alleged to have been committed.
This brill would repeal those provisions. The bill would retain existing law;
authorizing the arresting peace officer to select as the place for appearance either
(1 ) the location where bail may be received; or (2) the court having jurisdiction
within the county where the alleged offense took place that is nearest or most
accessible to the location of the alleged offense.
Introduction of AB 2218 was recommended by the Administration of the Danville-
Walnut Creek Municipal Court.
