BEFORE THE BOARD OF SUPERVISORS OF
CONTRA COSTA COUNTY
IN SPECIAL MEETING, 2 :30 P.M.
WEDNESDAY, APRIL 10, 1996
Following public comment and Closed Session, the Chairman of the
Board of Supervisors announced that in Closed Session, the Board
of Supervisors, by the vote hereinafter indicated, placed Joan
Sparks, Community Services Director, on indefinite administrative
leave in accordance with the medical restrictions advised by her
personal physician, and placed Scott Tandy, Chief Assistant
County Administrator, in full charge of the Community Services
Department for that period of time with direction to the County
Administrator and Mr. Tandy to communicate the Board' s concern to
the staff of the Community Services Department that the
Department focus its attention on compliance with the Federal
rules and regulations governing Head Start Programs. When the
County Administrator is advised by the Community Services
Director that she is able to return to work, further Board
consideration will then be undertaken whether such renewed
employment will be ordered or other action taken. Agreement to
this process was indicated by Joan Sparks through her attorney,
Israel G. Ramirez . ( Closed Session Vote: AYES: 1,4, 5, 2 NOES :

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY given that the Chair of the Board of Supervisors has called
a special meeting for Wednesday, April 10, 1996, at 2:30 p.m. in the Board Chambers
(Rooms 105 and 107), County Administration Building, 651 Pine Street, Martinez,
California, in closed session and in open session pursuant to Government Code
sections 54957.6 and 54957 to consider, and take action on the following:
1. CONFERENCE WITH LABOR NEGOTIATORS
Agency Negotiators: Leslie Knight, Aichard Heyne, and Keith Fleming (IEDA).
Employee Organizations: Contra Costa County Employees'Assoc., Local No. 1;
AFSCME Locals 512 and 2700; Calif. Nurses Assoc. (CNA); SEIU and Social Services
Union Local#535; C.C.C. Appraiser's Assn.; District Attorneys Inspectors Assoc.; Deputy
Sheriffs Assn. (DSA); United Prof. Firefighters, Local 1230; Contra Costa Physicians
Union; Western Council of Engineers; and Teamsters Local 315.
2. Public Employee Performance Evaluation: Community Services Director
3. Public Employee Discipline/Dismissal/Release Complaints and Charges

SUBJECT: Reply to Audit Transmittal Report TR96-002
Members of the Board:
The Department of Community Services and Development (CSD)
has reviewed Contra Costa County Community Services Department ' s
(CCCCSD) 3/11/96 reply to the subject report . The agency has
taken corrective action to clear two of five recommendations
cited in the subject report . All five findings/recommendations
are discussed below:
CONTRACT NO. 93BD-5013 (Recommendation Nos. 1 and 2)
CCCCSD agreed with Recommendation No. 1 concerning the
excess revenue due CSD for the Weatherization Program. CSD
Financial Services Unit will invoice CCCCSD for $592 .
Per Recommendation No. 2, CSD Financial Services Unit has
been informed by CSD Audit Services Unit to remit an additional
$70 to CCCCSD for the ECIP Program.
CONTRACT NO. 93F-1007 (Recommendation No. 3)
In the agency' s 3/11/96 reply, CCCCSD stated that they are
aware that $15, 610 (excess revenue) is due CSD for Contract No.
93F-1007 . However, CCCCSD stated that $11, 940 of this was paid
to a delegate agency. Since this delegate agency did not have
adequate documentation to account for the funds expended, this

amount was not picked up as a valid expenditure by the
independent auditor..
Consequently, CCCCSD contracted with an independent auditor
to reconstruct the delegate agency' s programmatic records and to
report the outcome to CCCCSD by 4/30/96 . A copy of this report
will be sent to CSD.
Recommendations:
A. Submit the independent auditor' s report to CSD when it
becomes available.
B. Remit the balance due on .Contract No. 93F-1007 to CSD.
The amount due CSD would be the difference between the $15, 610 in
excess revenue cited above and any additional audited
expenditures not previously reported by the independent auditor
on the Schedule of Federal Financial Assistance (FYE 6/30/93 and
6/30/94) .
CONTRACT NOS 93J-9708 94F-1107 AND 94F-1173
(Recommendation Nos. 4 and 5)
CCCCSD stated that the above contracts were inadvertently
omitted from the 1993-94 and 1994-95 single agency-wide audit
reports . The agency further stated that the expenditures for the
above contracts will be reported in the 1995-96 single agency-
wide audit report .
Recommendation:
C. Ensure that Contract Nos . 93J-9708, 94F-1107, and
94F-1173 are reported in the next single agency-wide audit report
(FYE 6/30/95) . The audited expenditures for the above three
contracts should encompass the FYE 6/30/93 and 6/30/94, as
applicable.
Please submit a written response within thirty (30) days
from the date of this letter. If a written response is not .
received within thirty (30) days, the questioned costs/excess
revenue will be considered valid; and, the agency will be
invoiced by the CSD Financial Services Unit .

Please be advised that the Contra Costa County Board of Supervisors will be
holding a closed session to consider your discipline, dismissal, release or other adverse
action, at a special meeting of the board on April 10, 1996 at 2:30 p.m. at the Board
Chambers (Rooms 107 and 105), County Administration Building, 651 Pine Street,
Martinez, California. Discussions between the board and administrative staff may
involve specific complaints or charges about you as an employee. This may occur in
the context of considering evaluations of your performance.
Pursuant to Government Code, § 54957, you have the right to have any
complaints or charges made by any person against you heard in a public session rather
than a closed session. The board may still meet in closed session to discuss and
deliberate on such matters.
You must indicate your request for a public session by completing and returning
one copy of this form to the Clerk of the Board of Supervisors prior to 11 a.m. on
Wednesday, April 10, 1996. If you do not return this form, it will be assumed that you
do not wish to exercise your right to a public session.
If you request a public session, then discussions relating to the above matters
may be discussed publicly, with an opportunity for public comment.
