SUBJECT: Grant Partial Exception to Drainage Requirements. Minor Subdivision 85-90, Vine Hill
Area, Martinez.
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE the following modifications to the conditions of approval for Minor Subdivision No. 85-
90:
a. Permit the installation of one Type A drainage inlet, approximately 55 feet of storm drain
pipe, and the bottom half of a second drainage structure in lieu of full "collect and
convey", and
b. Permit storm drainage discharge into the Sycamore Street roadside ditch with minor ditch
improvement, if necessary for capacity, and
C. Approve the construction of the above under an encroachment permit.
II. Financial Impact:
No direct financial impact.
III. Reasons for Recommendations and Background:
Mr. Larry Heltsley (the applicant's partner) has .brought to our attention that conditions of
approval numbers 5.A.4&5 were not accurately explained to him by staff prior to the public
hearing for this project. Furthermore, now that we have explained these conditions to him he
feels that they place an extreme burden on his project.

III. Reasons for Recommendations and Background (Cont.):
This project lies in an area of deficient drainage improvements, and in order for the conditions
to be met as were originally approved by the Zoning Administrator, the applicant would be
required to install two drainage inlets and approximately 225 feet of storm drain pipe. The
entitlement received by Mr. Heltsley yielded one additional residential lot.
We have met with Mr. Heltsley at the site and have also met with the Flood Control Division.
Staff believes the above modified conditions represent an equitable solution.
IV. Consequences of Negative Action:
The new homes are already built, and the applicant has stated that if he is required to comply
with the existing conditions of approval he will not split the property. Instead he will retain all the
homes and rent them out. This would result in a loss of available moderately priced owner
occupied housing in this area. The surrounding community has supported this project because
it would provide more opportunity for owner occupation.
Furthermore, if this project is not completed the proposed area-wide drainage improvements will
not be installed.
