SUBJECT: Accepting completion of private improvements (Elan Lane, N. Donovan Way, S.
Donovan Way, and Craiglee Way), Subdivision 01-08153,'San Ramon(Dougherty
Valley) area. (District III)
These improvements are approximately located east of Bollinger Canyon Road.
The Public Works Director has notified this Board that the improvements in Subdivision 01-
08153 have been completed as provided in Subdivision Agreement with Windemere BLC Land
Company, L.L.C., heretofore approved by this Board in 'conjunction with the filing of the
Subdivision Map.

SUBJECT: Accepting completion of private improvements (Elan Lane, N. Donovan Way, S.
Donovan Way, and'Craiglee Way), Subdivision 01-08153,San Ramon(Dougherty

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as:ofAugust 16, 2005 thereby establishing the six-month terminal:period for the filing of liens in
case of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment(labor and materials) surety for$637,500.00,
Bond No. SV9482 issued by the:.above'surety be RETAINED for the six month lien guarantee
period until February 16,2006, at which time the Clerk of the Board is AUTHORIZED to release
the surety less the amount of any claims on file,
BE IT FURTHER RESOLVED that the private improvements have been COMPLETED
and are ACCEPTED`as COMPLETE.
BE IT FURTHER RESOLVED that there is no warranty period'required, and the Public
Works Director is AUTHORIZED to refund the $12,750.00 cash security for performance
(Auditor's Deposit Permit No. 391338, dated August 13, 2002) plus interest in accordance with
Government Code Section 53079, if appropriate, to Win emere BLC Land Company, L.L.C.
pursuant to the;requirements of the Ordinance Code; and the Subdivision Agreement and surety
bond,Bond No. SV9482 (dated August 1,2005),DP number 391338 (dated August 13,2002), are
exonerated.
