Pursuant to Division 17 of the Public Resources Carle with particular reference to Chapter I (commencing
with Section 26500), Article 3 (commencing with Section 26550) and Article 4 (commencing with
Section 26561)
RECITALS.
A. On February 12, 2002, the Contra Costa County Board of Supervisors adopted Resolution No. 2002/59,
approving and ordering the formation of the Wendt Ranch Geologic Hazard Abatement District(GHAD)and
appointing itselfto act as the Board of Directors of the GHAD(CHAD Board). This formation was described
in the petition dated February 12,2042 and in the GRAD Plan of Control dated February 20,2091.
B. On June 21, 2005,the CHAD Board presented the Petition for Annexation of Territory to the Wendt Ranch
Geologic Hazard Abatement District(GHAD Petition),which is attached as Exhibit l. The territory proposed
to be annexed into the GHAD is identified in the boundary map as shown in the Attachment A of Exhibit_1.

C. On June 21, 2005, the GHAD Board was presented with Revision 1 to the Wendt Ranch GRAD Plan of
Control(dated May 24, 2005),which is on file at the office of the Clerk of Board and the Public Works;
Department. Revisions to the Plan of Control have been made to reflect the following: (1)annexation:of the
Alamo Creek and Intervening Properties projects into the GRAD; (2) ownership of the open space by the
CHAD instead of the Horne Owners'Associations;and(3)maintenance of additional water quality facilities
(including water quality and bioretention basins),fire breaks and trails,and restoredcreek'channels(if funded
by the developers of the Alamo Creek and Intervening Properties projects). If adopted, the Revised Plan of
Control would replace in its entirety the original Plan of Control dated February 20, 2001 and adopted on
February 12, 2002'by Resolution No. 2002/59.
THE BOARD OF DIRECTORS OF THE WENDT'RANCH GEOLOGIC HAZARD ABATEMENT
DISTRICT RESOLVES AND ORDERS THAT:
I. The GRAD Board concludes that the Revised Plan of Control is substantially in the form described in Sections
26552 and 26509 of the Public''Resources Code and the CHAD'Petition is substantially in the form described
in Section 26552 of the Public Resources Code.
2. The proposed revisions to the Plan of Control are exempt from the provisions ofthe California Environmental
Quality Act(Pub.Res.Code§§ 21000 et seg.)in accordance with Public Resources Code section 21080(b)(4)•
3. The Public Works Director shall mail, by first class mail, a written notice of the hearing to consider the
proposed annexation and the Revised'Plan of Control to each owner of real property proposed to be annexed to
the GHAD or currently within the GHAD boundaries.
4 This Resolution shall become effective immediately upon its passage and adoption.

PETITION FOR ANNEXATION OF TERRITORY TO THE
WENDTRANCH GEOLOGIC HAZARD ABATEMENT DISTRICT
PURSUANT TO DIVISION 17 (commencing with section 26500)
OF THE PUBLIC RESOURCES CODE OF THE STATE OF CALIFORNIA
TO: The Clerk of the Wendt Ranch Geologic Hazard Abatement District("GRAD")(Clerk ofthe
Board of Supervisors)
The undersigned owners of land within the boundaries of the territory proposed to be annexed to the
GRAD hereby request that the Board.of Directors of the CHAD(GHAD Board)initiate proceedings
to annex the territory described in Attachment A (Boundary Map) and Attachment B (Legal
Description), attached: hereto, to the CHAD pursuant to Article 3 (commencing.with Public
Resources Code § 26550) and Article 4 (commencing with Public Resources Code § 26561) of
Chapter 2 of Division 17 of the Public Resources Code (§ 26500 et seq.). Said owners are the
owners of all the territory proposed to be annexed.
(a) This petition is made pursuant to Division 17 of the Public Resources Code with
particular reference to Article 3(commencing with Section 26550)and Article 4(commencing with
Section 26561).
(b) Opposite the signature of each petitioner is an indication of the lot,tract and map number
or other legal description sufficient to identify the signature of the petitioner as that of an owner of
land within the territory proposed to be annexed to the CHAD.
(c) Opposite the signature of each petitioner is an indication of the date on which said
petitioner's signature was affixed to this petition.
(d) The following documents are attached to this petition and are incorporated Herein by this
reference as if set forth in full in the petition:
1. A reap of the boundaries of the territory proposed to be annexed to the GHAD
(Attachment A);
2. A legal description of the boundaries of the territory proposed to be annexed'to the
CHAD(Attachment B); and
3. Revision 1 to the Wendt Ranch CHAD Plan of Control prepared by an engineering
geologist certified pursuant to Section 7822 of the California Business and Professions Code,which
describes in detail georgic hazards,their location and the areas affected thereby,and a plan for their
prevention,mitigation,abatement and control thereof(Attachment Q.
