ACCEPT the filing of the Preliminary Engineer's Report for County Service Area M-28 for Fiscal Year 2005/2006. 2. FIX July 26,2005 at 9:30 a.m.in the Board of Supervisors' Chambers,651 Pine Street,Martinez,California, as the time and place for a public hearing to consider oral and written objections and protests,if any,concerning the Fiscal Year 2005/2006 report. 3. DIRECT the Clerk of the Board to publish a Notice of Filing of the Preliminary Engineer's Report and fixing of public hearing thereon in accordance with Government Code Section 25210.77a (Government Code Section 6066) and County Ordinance Code Section 1012-2.608. DIRECT the Public Works Director or his designee,to mail written notice to the record owner or owners no later than 45 days prior to the public hearing, in accordance with California Constitution, art. 13D, Sec. 6 5. DIRECT that the County shall make immediately available to the public at the office of the Clerk of the Board and the Public Works Department, a copy of the Preliminary Engineer's Report. FISCAL IMPACT: The above actions have no impact on County General Fund. County services to County Service Area M-28 are funded entirely by the annual service charges obtained from the users of the water,in accordance with Government Code Section 25210.77a. REASONS FOR RECOMMENDATIONS AND BACKGROUND: The proposed annual levy of water service charges benefits all property owners within County Service Area M-28 by providing for a community water system (miscellaneous extended service) in accordance with Government Code Section 25210.4(4). The County Service Area M-28(miscellaneous extended service)includes,but is not limited to, the acquisition, construction, operation, replacement, maintenance, and repair of water supply and distribution systems, including land, easements, rights-of-way, and water rights [Government Code Sections 25210.4a(1)]. CONSEQUENCES OF NEGATIVE ACTION: The District would be unable to have the Fiscal Year 2005/2006 water service fees collected by the County Tax Collector, and would have to use an alternate method to collect the service fees. ,. , 2 77 . Upon adoption of this report by the Board of Supervisors, the charges contained herein will be collected on a tax roll of Contra Costa County in the same manner,by the same persons,at the same time as, and together with, the County's general taxes.
