"Development rights" are defined to mean and refer to the right to disapprove of any proposed
construction, development or improvement on any of the lots described in Exhibit "A". The
"development rights" are and shall be a form of negative easement, which'shall run with the said

Affecting Parcels A& B are the following disclosures
1. The following disclosure affects parcel B:Issuance of a building permit will be reliant upon the
owners submittal of a building permit site plan which incorporates all site development
recommendations as contained in the approved tree report prepared by Atlas free Service, darted May
25 and August 24, 2004 on file with the Contra Costa County Community Development department,file
No. MS04-009.
2. The following disclosure affects Parcel B: The issuanceof a building permit will be reliant upon the
construction plan set submitted for'.building permit issuance containing the following notes:
A. All construction activities shall be limited to the hours of 7:30 A.M. to 5:00 P.M.,Monday'
through Friday, and shall be prohibited on Saturdays and Sundays as well as State and Federal
holidays.
B. The project sponsor shall require their contractors and subcontractors to fit all internal
combustion engines with mufflers which are in good condition and shall locate`stationary noise-
generating equipment such as air compressors and concrete pumps as far away from existing
residences as possible.
C. At least one week prior to commencement of grading,the applicant shall post the site and mail to
the owners of property within 300 feet of the exterior'boundary of the project site notice that
construction work will commence. The notice shall include a list of contact persons with name,
title,phone number and area of responsibility. The person responsible for maintaining the list
shall be included. The list shall be kept current at all times and shall consist of persons with au-
thority to indicate and implement corrective action in their area of responsibility. The names of
individuals responsible for noise and litter control, tree protection,;construction traffic and vehi-
cles, erosion control, and the 24-hour emergency number, shall be expressly identified in the
notice. The notice shall be re-issued with each phase of major grading and construction activity.
A copy of the notice shall be concurrently transmitted to the Community Development
Department. The notice shall be accompanied by a list of the names and addresses of the
property owners noticed, and a map identifying,the area noticed.
D. A dust and litter control program shall be submitted for the review and approval of the Zoning'
Administrator. Any violation of the approved program,or applicable ordinances shall require an
immediate work stoppage. Construction'work shall not be allowed to resume until, if necessary,
an appropriate'construction bond has been posted.
E. The applicant shall make a good--faith effort to avoid interference with existing neighborhood
traffic flows. Prior to issuance of building permits,the proposed roads serving this development
shall be constructed to provide access to each lot. This shall include provision for an on-site area
in which to park earth moving equipment.

F. Transporting of heavy equipment and trucks shall be limited to weekdays between the hours of
9.00 AM and 4:00 PM and prohibited on Federal and State holidays.
G. The site shall be maintained in an orderly fashion. Fallowing the cessation of construction
activity, all construction debris shall be removed from the site.
3. The following disclosure affects Parcel B:Prior to issuance of a building permit, they will be required
to contribute to the County$1,000.00 for police services mitigation.: The fee maybe paid to the Contra
Costa County Application &Permit Center.
4. The following disclosure affects Parcel B:Should archaeological materials be uncovered during
grading, trenching or other onsite excavations, earthwork within 30 yards of these material shall be
stopped until a professional archaeologist who is certified by the Society of Professional Archaeology
(SOPA) has had an opportunity to evaluate the significance of the find and suggests appropriate
mitigation(s), if deemed necessary.
5. The following disclosure affects Parcel B:A preliminary geology and soils report prepared by
Terrasearch, Inc., Project No. 10342.G, dated April 22, 200.5is available from the current owner
(report includes Preliminary Geologic Feasibility Evaluation dated August 12, 2004; Geologic
Investigation dated April 6, 2005; and Response to Geologic Peer Review, dated April 22, 2005) . The
report is also on file with the Contra Costa Community Development Department, File No. MS O4-0009.
The issuance of a building permit will be reliant upon the construction documents being prepared its
substantial compliance with the recommendations contained in the preliminary geology and soils report.
The site contains potential geologic and geotechnical hazards, which include a,) landslide, b.)severely"
expansive soils and expansive (clayey) bedrock, c.)soil creep, and d.)possible corrosive soils. A
geotechnical report shall be'requir-ed prior to the issuance of a building or grading permit.
6. The following disclosure affects Parcel B: Prior to obtaining a building permit, the applicant must'
comply with the Small Lot Occupancy Ordinance design reviewprocess. The applicant shallprovide
the Community Development Department with site plan, grading plan, building elevations and floor
plan with an application for Design Review. The County shall notify owners of nearby properties of the
proposed development and provide them an opportunity to request a public hearing.
7. The following disclosure affects Parcel B: Prior to obtaining a building permit; the applicant must ,
submit improvement plans prepared by a registered civil engineer to the Public Works Department,
Engineering Services Division, along with review and inspection fees, and security for'all improvements
required by the Ordinance Code for the conditions of approval for MSO4-0009.
8. The following disclosure affects Parcel B:Prior to obtaining a buildingpermit, the applicant must
furnish proof to Public Works of the acquisition of all necessary rights of way, rights of entry,permits
andlor easements for the construction of off-site, temporary or permanent,public and private road and
drainage improvements.
9. The following disclosure affects Parcel B: Prior to obtaining a building permit; the applicant must
obtain an encroachment permit from the Application and Permit Center for construction of driveways or
other improvements within the right of way of Benthill Court and/or Taylor Boulevard

demonstrate, to the satisfaction of the Public Works Department and Zoning Administrator, that large

sufficiently negotiate ingress and egress of the entire length of the private road, the entrance off Benthill
Court, and each of the residential driveways.
11. The following disclosure affects Parcel B:Prior to obtaining a building certificate of occupancy, the
applicant shall construct a paved turnaround at the end of the proposed private road in accordance'with
County private road standards.
12. The following disclosure affects Parcel B: Prior to obtaining a building certificate o,f'occupancy the k
applicant shall construct an on-site roadway system to current County private road and Fire.District
standards with a minimum traveled width of 16 feet within a 25-foot access easement.

13. The following disclosure affects Parcel B:At least thirty days prior to obtaining building permits for
Parcel `B'', the applicant shall submit site plans, elevations,,floor plans,and grading plans for review
and approval of the Zoning Administrator. A small lot design review application and appropriate filing
fees,will be required. The horse shall be designed to reduce visual impacts from Taylor Blvd. The
design will need to incorporate the following guidelines:
i
a. Cut the home into the slope to reduce the effective visual bulk.
b. Step the building up the slope rather than have a single.floor height.
c. Break=up the building mass into smaller elements. Large vertical planes on the
downhill side are discouraged.
14. The fallowing disclosure affects Parcel B: Prior to issuance of a grading permit or building permit,
the applicant shall.
• Submit a tree planting and irrigation plan prepared by a licensed arborist or landscape architect for
the review and approval of the Zoning;Administrator. The plan shall provide for the planting of at
least 39 trees,fifty percent of which must be native trees. All replacement trees shall be a minimum
of I5 gallons in size. The consulting arborist shall recommend the particular species of native trees.
The plan shall be accompanied by an estimate,prepared by a licensed landscape architect or
arborist, of the material and labor costs to complete the improvements on the plan.
• Submit a security(e.g., bond, cash, deposit) that is acceptable to the Zoning Administrator. The
bond shall include the amount of the approved cost estimate,plus a 20%inflation surcharge, Until
evidence is submitted that the applicant has satisfactorily installed the required improvements, the
County may hold the security for up to a year following the installation of the trees.
• :Prior to seeking finalization of the building or grading permit, the applicant's arborist shall verify if
the replacement trees have been properly planted and when verified notify the Community
Development in writing.
• and the applicant shall pay fees,for all time and material costs of staff time for processing a
landscape improvement security(Code,S f160B).
15. The following disclosure affects Parcel B:Prior to issuance of a grading permit or building permit,
the applicant shall be subject the following requirements:
Pursuant to the requirements of Section 816-6.1204 of the Tree Protection and
Preservation Ordinance, to address the possibility that construction activity nevertheless
damages these trees, the applicant shall provide the County with a security(e.g., bond,
cash deposit)to allowfor replacement of trees intended to be preserved that are

significantly damaged by construction activity. This security shall be provided prior to
the applicant receiving building permits for the property and it shall be based on
a. Extent of Possible Restitution Improvements- The planting of up to 9 native trees,
minimum I5-gallons in size in the vicinity of the affected trees, or equivalent planting
contribution, subject to,prior review and approval of the Zoning Administrator.
b. determination of Security Amount- The security shall provide for all of the
following costs:'
• Preparation'of a landscape/irrigation plan by a licensed landscape architect or
arborist;
• '`A labor and material estimate for planting the potential number of trees and
related irrigation improvements'that may be required,prepared by a licensed
landscape contractor; and
• An additional 20%of the total of the Above amounts to address inflation costs.
C. Initial Deposit for Processing of Security- The County ordinance requires that the
applicant cover all time and materials costs o,f`staff for processing a tree protection
security(Code S-060B). T he Applicant shall pay an initial fee deposit of$500 at time of
submittal of a security.
The security shall be retained by the County up to 24 months following the completion of
the tree alteration improvements. In the event that the Zoning Administrator determines
that trees intended to be protected Have been damaged by development activity,and the
Zoning Administrator determines that the applicant has not been diligent in providing;
reasonable restitution ofthe damaged trees, then the Zoning Administrator'may require
that all or part of the security be used to provide for mitigation of the damaged trees.
At least 18 months following the completion of work within the drip line of trees, the
applicant's arborist shall inspect the trees.for any significant damage from construction
activity, and submit a'report on his/her conclusions on the health of the trees and, if
appropriate, any recommendations including further methods required for tree'
protection to the Community'Development Department.
16 The following disclosure affects parcel'B.New residences or other new:.habitable structures shall be
designed to comply with the Sound'Transmission Control,Standard of the Uniform Building Code for the
State of California 198.9 Amendments. Structural design shall be based on the recommendations of an
acoustical study of the site by an acoustical engineer to ensure that interior noise levels do not exceed a
C'NEL of 45 dB and that exterior noise levels do not exceed CNEL of 60dB
17. The following disclosure affects Parcel B:In accordance with the growth management standards of
the Contra Costa County General Plan, all new residences shall have fire,sprinklers installed. Prior to
obtaining building-permits, the applicant shall provide documentation,from the''Contra Costa County
Fire Protection District, that the sprinkler system, shown on the building plans, meets the requirements
of the fire protection district.

18. The fallowing disclosure affects Parcels`A&B:Future property owners shall be subject to the

owners of a lot.
19. The following disclosure affects Parcel B: "No Parking"signs shall be installed along the private
road subject to the review and approval of the Public Works Department.
20. The following disclosure affects Parcel B: Provide for at least sixon-site parking spaces per lot to be
located outside the private road easement extending from B"enthill Court. At least one of the six space,
for each lot shall be far guest parking.
21. The following disclosure affects Parcel B: Prior to issuance of a building permit the applicant must
demonstrate that all new and existing utility distribution facilities service Parcel "B" will be installed
underground:
22. The following disclosure affects Parcel B: The applicant shall collect and convey all storm water
entering and/or originating on this property without diversion and within an adequate storm drainage
facility, to a natural watercourse having definable bed and banks, or to aro existing adequate public
storm drainage facility which conveys the storm waters to a natural watercourse, in accordance with
Division 914 of the Ordinance Code. The applicant shall furnish proof to the Public Works Department,
Engineering Services Division, that he has the necessary rights, via an easement or drainage release, to
discharge storm water into the earth channel north of the property, unless it is a natural watercourse
(i.e. stream or creek).
23. The following disclosure affects Parcel B: The applicant shall construct a concrete ditch behind the
retaining wall alongside the private road.
24. The following disclosure affects Parcel B: Prior to issuance of a building permit the applicant must
demonstrate that any new drainage facilities shall be designed and constructed in accordance with
specifications outlined in Division 914 and incompliance with design standards of the Public Works
Department.
25. The following disclosure affects Parcel B: Prier to issuance of a building permit the applicant shall
demonstrate that the proposed site improvements prevent storm drainage from draining across the
sidewalk(s)and''driveway(s) in a concentrated manner'.
26. The following disclosure affects Parcel B: The applicant building permit application will be subject
to the following'requirements:
The applicant shall be required to comply with all rules,'regulations, andprocedures of the National
Pollutant Discharge Elimination Systems (NPDES)for municipal, construction and industrial
activities as promulgated by the California State Water Resources Control Board, or any of its
Regional Water Quality'Control Boards (San Francisco Bay-Region II or Central Valley-Region
V).
Compliance will include developing long.-term best management practices (BMP's)for the reduction or
