Contact: Eric Hu(3132192) cc: S.Kowalewski,TE B.Fernandez,TE ATTESTED: MAY 03, 2005 W.Lai,TE C.Lau,TE JOHN SWEETEN,Clerk of the Board of C.'Raynolas,'PW Accounting Supervisors and County Administrator By Deputy RESOLUTION NO. 2005/ 267 SUBJECT: AUTHORIZING THE FILING OF AN APPLICATION FOR FEDERAL SURFACE TRANSPORTATION PROGRAM AND CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT PROGRAM FUNDING FOR BYRON HIGHWAY WIDENING AND OVERLAY AND COMMITTING THE NECESSARY LOCAL MATCH FOR THE PROJECT(S) AND STATING THE ASSURANCE OF CONTRA COSTA COUNTY TO COMPLETE THE PROJECT DATE: May 3, 2005 PAGE: 2 of 3 WHEREAS, the Metropolitan Transportation Commission is the MPO for the San Francisco'Bay region; and WHEREAS, CONTRA COSTA COUNTY is an eligible project sponsor for Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds;and WHEREAS, CONTRA COSTA COUNTY wishes to submit a grant application to MTC for funds from the Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program in Second Cycle for the following project: The Byron Highway'Widening and Overlay(Phase I and II) The project limit for the first phase includes Byron Highway from Byron Hot Springs Road to 1,500 feet north of North Bruns Way, and the project limit for the second phase includes Byron Highway from 1,500 feet north of North Bruns Way to the Alameda County line. The project scope for both phases consists of placing 0.2-foot thick'asphalt concrete overlay over the existing roadway; and the existing shoulder will be widened to 4 feet on each side of the roadway. Striping removal and replacement'are also included in the project scope.: Tree removal and minor drainage improvements will be included as needed within the project limit. WHEREAS,MTC requires,as part of the application,a resolution stating the following: 1) the commitment of necessary local matching funds of at least 11.47%; and 2) that the sponsor understands that the Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program funding is fixed at the programmed amount, and therefore any cost' increase cannot be expected to be funded with Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds; and 3) the assurance of the sponsor to complete the project as described in the application, and if approved, as programmed in MTC's'TIP; and 4) that the sponsor understands that funds must be obligated by June 30 of the year that the project is programmed for in the TIP, or the project may be removed from the program. Resolved,that CONTRA COSTA COUNTY is an eligible sponsor"of projects in the STP, CMAQ and TE Program; and be it further Resolved, that CONTRA COSTA COUNTY is authorized to submit an application for STP, CMA Q, and TE funds for BYRON HIGHWAY WIDENING AND V VERLAY; and be it further Resolution No. 2005/ 267 SUBJECT: AUTHORIZING THE FILING OF AN APPLICATION FOR FEDERAL SURFACE TRANSPORTATION PROGRAM AND CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT PROGRAM FUNDING FOR BYRON HIGHWAY WIDENING AND OVERLAY AND COMMITTING THE NECESSARY LOCAL MATCH FOR THE PROJECT(S) AND STATING THE ASSURANCE' OF CONTRA COSTA COUNTY TO COMPLETE THE PROJECT DATE: May 3, 2005 PAGE: 3 of 3 Resolved, that there is no legal impediment to CONTRA COSTA COUNTY making applications for STP,'CMAQ, and'TE funds; and be it further Resolved, that there is no pending or threatened'litigation which might in any way adversely affect the proposed project, or the ability of CONTRA COSTA COUNTY to deliver such project,and be it further NOW,THEREFORE,'BE IT RESOLVED by CONTRA COSTA COUNTY BOARD OF SUPERVISORS that CONTRA COSTA COUNTY is authorized to execute and file an application for funding under the Surface Transportation Program or the Congestion Mitigation and Air Quality Improvement Program of TEA-2I Reauthorization in the amount of$709,000 for BYRON HIGHWAY WIDENING AND OVERLAY; and BE IT FURTHER RESOLVED that CONTRA COSTA COUNTY BOARD OF SUPERVISORS by adopting this resolution does hereby state that: 1) CONTRA COSTA COUNTY will provide $91,858 in local matching funds; and 2) CONTRA COSTA COUNTY understands that the Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program funding for the project is fixed at $709,000, and that any cost increases must be funded by CONTRA COSTA COUNTY from local matching funds, and that CONTRA COSTA COUNTY does not expect any cost increases to be funded with Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds; and 3) BYRON HIGHWAY WIDENING AND OVERLAY will be built as described in this resolution and,if approved, for the amount shown in the Metropolitan Transportation Commission(MTC) Transportation Improvement Program (TIP)with obligation occurring within the timeframe established below; and 4) The program funds are expected to be obligated by September 30 of the year the project is programmed for in the TIP. BENT FURTHER RESOLVED that a copy of this resolution will be transmitted to the MTC in conjunction with the filing of the application; and BE IT FURTHER RESOLVED that the MTC is requested to support the application for the project described in the resolution and to program the project, if approved,in MTC's TIP: RESOLUTION NO. 20051 267
