HomeMy WebLinkAboutRESOLUTIONS - 12202005 - 2005-789 EXHIBIT "B" Resolution No. 2005/789 THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA Adopted this Order on Tuesday, December 20, 2005 by the following vote: AYES: Gioia, Piepho, DeSanlnier,Glover and Uilkema NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 2005/789 SUBJECT: RESCIND existing Land Conservation ) Contract No. 9-71for the 376 Acres ) Comprising APN 205-040-002 ) AUTHORIZE the Execution of ) new Land Conservation Contract ) No. 05-0001 with Gordon R. and Karen Rasmussen } For Four Parcels Created Under County File: ) MS#96-0014 Affecting APN 205-040-002 ) The Board of Supervisors of Contra Costa County RESOLVES that: On January 19, 1971, the Board of Supervisors adopted Resolution No. 71/36, which authorized the Chairman of the Board to execute Land Conservation Contract No. 9- 71 with Edward C. Rasmussen, covering 609.53 acres near Highland Road (Tassajara area) involving APN 205-040-002 and 205-060-002 (County File: RZ#1484), and said contract was subsequently executed by the Board Chair and then recorded with the County Recorder on February 25, 1971. On December 11, 1991, a Notice of Non-Renewal was filed with the County on APN 205-060-002, which subsequently removed approximately 233 acres from Land Conservation Contract No. 9-71 ten years later on February 2, 2002. On December 8, 1998, the County Planning Commission approved a minor subdivision (County File: MS#96-0014)dividing APN 205-040-002 into four new parcels of 87, 102.88, 87.69, and 98.53 acres, respectively. On February 2, 2005, Gordon R. and Karen Rasmussen, the current owners of APN 205-040-002 filed an application with the Community Development Department requesting to rescind Land Conservation Contract No. AP 9-71 affecting APN 205-040-002 and to enter into a new Land Conservation Contract to reflect the agricultural or compatible uses, agricultural related structures, and residences that are identified for the four new parcels created under approved minor subdivision (County File: MS#96-0014)affecting APN 205- 040-002 . RESOLVED that, pursuant to Section 66474.4 of the California Government Code, the Board of Supervisors finds that the approved minor subdivision affecting land subject to the California Land Conservation Act of 1965 (Williamson Act)would neither result in the creation of parcels too small to sustain agricultural use of the land nor result in residential development not incidental to the commercial agricultural use of the land. RESOLVED that, pursuant to Section 51254 of the California Government Code, the Board of Supervisors RESCINDS Land Conservation Contract No. 9-71 as it affects the 376 acres comprising APN 205-040-002, now subdivided into four parcels under County File: MS#96-0016, and AUTHORIZES the Board Chair to execute a new contract, Land Conservation.Contract No. 05-0001, with Gordon R. and Karen Rasmussen. /�C-ASO/�6 7� /f/® • �' �8 The Board further DIRECTS the Community Development Department to forward a copy of this resolution and the executed version of the new contract, Land Conservation Contract No. AP 05-0001, to the California Department of Conservation and the Office of County Assessor.
