RESOLUTION NO. 2004/ 85 ,
SUBJECT: Accepting completion of right-of-way-landscaping improvements and releasing of
cash deposit for faithful performance for Subdivision 8250,Rodeo area.(District 11)
The Public Works Director has notified this Board that the right-of-way landscaping
improvements in Subdivision 8250 have been completed as provided in the Right-of-Way
Landscaping Agreement with Schuler Homes of California,Inc.,heretofore approved by this Board
on July 27, 1999.

SUBJECT: Accepting completion of right-of-way-landscaping improvements for Subdivision
8250,Rodeo area. (District II)

NOW THEREFORE BE IT RESOLVED that the warranty period has been completed,and
the Public Warks Director is AUTHORIZED to refund the$1,000.00 cash security for performance
(Auditor's Deposit Permit No. 334929, dated July 14, 1999) plus interest in accordance with
Government Code Section 53079,if appropriate,to Schuler Homes of California;,Inc.pursuant to the
requirements of the Ordinance Code and the Right-of-Way Landscaping Agreement.
BE IT FURTHER RESOLVED that the warranty period has been completed,and the Right-
of-Way landscaping agreement and surety bond are EXONERATED.
