(District III) On March 25,2003,this Board resolved that the improvements for Point of Timber Road for Road Acceptance 00-01100(cross-reference Subdivision 8423)were completed as provided in the Road Improvement Agreement with Hofmann Land Development Company and now on the recommendation of the Public Works Director; The Board hereby FINDS that the improvements have satisfactorily met the guaranteed performance standards for the period following completion and acceptance.NOW THEREFORE BE IT RESOLVED that the Public Works Director is AUTHORIZED to refund the $4,800.00 cash deposit(Auditor's Deposit Permit No. 401184,dated February 27,2003)plus interest to Hofmann Land Development Company in accordance with Government Code Section 53079(if appropriate), Ordinance Code Section 94-4.406, and the subdivision agreement. BE IT FURTHER RESOLVED that the warranty period has been completed and the Road Improvement Agreement and the performance/maintenance surety for $71,535.00, Bond No. ST8711,'issued by St. Paul Fire and Marine Insurance Company are exonerated.
