IMPROVEMENT PLAN WARRANTY.Subdivider warrant the improvement plans for the Work are adequate to accomplish the Work as promised in Section 2 and as required by the Conditions of Approval for the Subdivision, If,at anytime before the Board of Supervisors accepts the Work as complete or du6rq the one year guarantee period,said improvement plans prov#to be inadequate in any respect,Subdivider shah make whatever changes are necessary to accomplish the Work as promised. 7. NO WAIVER§Y COUNTY. COSTS.Subdivider shah pay,when due,all the costs of the Work,including but not limited to the costs of relocation of existing utilities required thereby;inspections;material dhecksand tests;and othercosts incurred by County staff arising fromorrelated to the Wotfr,and prirnieac eptancsoftheWorkascompieleorexpirationofanyappliartlewa"periods, whichever is later. 10. SURVEYS. Subdivider shall set and establish survey monuments In accordance with the fried map and to the satisfaction of the County Road Commissihner-Surveyor before acceptance of the Work as complete by the Board of Supervisors. it. NON-PEI FORMANCE AND COSTS. if Subdivider fails to complete the Work within the time specified in this Agreement and subsequentextensions,or fails to maintain the Work,County may proceed to complete and/or maintain the Work by contract or otherwise and Subdivider agrees to pay all costs and charges incurred by County(including,butnot limited to,engineering,Inspection,surveys,contract,ovetlt W,at)immediately upon demand.
