The Public Works Director has notified this Board that the of public (widening of Reliez
Valley Road)and private(Ariey Lane)improvements in Subdivision 89-07410 have been completed
as provided in the Subdivision Agreement with Old Oak Land Company, L.L.C., heretofore
approved by this Board in conjunction with the filing of the Subdivision Map.

SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 2004! 419 for Subdivision 89-07410, accepting completion of public(widening of
Reliez Valley Road) and private(Ariey Lane)improvements,Pleasant Hill area. (District II)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION($):
The developer,Old Oak Land Company L.L.C.,has installed the improvements(both public and private)in a good
workmanlike manner as required in the improvement plans and in conformance with the County Ordinance Code.
CONSEQUENCES OF NEGATIVE ACTION:
The developer will not start the gu e perform c eriod t'1 the improvements are accepted as complete.

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of August 3,2004 thereby establishing the six-month terminal period for the filing of liens in case
of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment(labor and materials) surety for$289,179.00,
Bond No. 8680975 issued by the above surety be RETAINED for the six month lien guarantee
period until February 3,2005,at which time the Clerk of the Board is AUTHORIZED to release the
surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the widening ofReliez Valley Road is ACCEPTED and
DECLARED to be a County road;the right-of-way was conveyed by separate instrument,recorded
on August 28, 2002 , in Book 446 of Maps at Page 28.
BE IT FURTHER RESOLVED that the private improvements (Ariey Lang) have been
COMPLETED and are NOT ACCEPTED NOR DECLARED as County roads, at this time.
BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby
established, and the $2,921.00 cash bond (Auditor's Deposit Permit No. 390395 , dated July 25,
2002)made by R&J Construction, Inc. and the performance/maintenance surety for$289,179.00,
Bond No. 8680975 issued by Developers Surety and Indemnity Company be RETAINED pursuant
to the requirements of Section 94-4.406 of the Ordinance Code until release bythis Board.
