WHEREAS, effective February 28, 1989, the County of Contra Costa ("COUNTY), the City of Antioch ("ANTIOCH"), and the City of Brentwood ("BRENTWOOD") entered into a Joint Exercise of Powers Agreement ("JEPA") forming the State Route 4 Bypass Authority ("AUTHORITY"), a joint powers agency. WHEREAS, the AUTHORITY was farmed for the purpose of planning and developing the State Route 4 Bypass (formerly known as the Delta Expressway), a regional highway project that runs from the State Route 4/160 interchange in Antioch to State Route 4 and Vasco Road south of BRENTWOOD. WHEREAS, the JEPA has been amended seven times, the last of which added the newly incorporated City of Oakley("OAKLEY") as a party in 1999. WHEREAS, Segment 1 of the PROJECT, which includes roadway and interchange improvements from the State Route 4/State Route 160 Interchange south to Lone Tree Way, has been divided into two bid packages hereinafter referred to as Package 1 and Package 2. DATE: July 27, 2004 PAGE: 2 WHEREAS, construction related to Package 1 is ready to commence and the JEPA requires the approval of the project design and project plans and specifications prior to construction; NOW,THEREFORE,THE BOARD RESOLVES THAT: The Board APPROVES the Project plans and specifications and the project design for Segment 1, Bid Package 1 on behalf of the COUNTY. For all further segments and bid packages of the State Route 4 Bypass Project, the Board DELEGATES to the AUTHORITY Board the authority to approve plans and specifications and project design on behalf of the COUNTY and DECLARES that such approval by the AUTHORITY Beard shall constitute approval by the COUNTY. This agency was established to administer and set policy for the State Route 4 Bypass(Bypass)project. In 1999 the City of Oakley joined the Authority. The Bypass project is a regional highway project beginning at the existing State Route 4/State Route 160 interchange in Antioch and continuing south through Brentwood approximately 9.6 miles to Vasco Road at Walnut Boulevard. Segment 2, between Lone Tree Way and Balfour Road, was completed in 2002 and was the first phase of the project to be completed. Segment 1, between existing State Route 4 and Lone Tree Way,has been divided into two bid packages. Bid Package 1 primarily involves grading and bridge construction within Caltrans right of way at the north end of the project as well as the transportation of dirt for the Lone Tree Way interchange embankment. Bid Package 2 involves the construction of the Bypass freeway mainline from SR4/SR160 to Lone Tree Way and interchanges at Laurel Road and Lone Tree Way. The total estimated cost for both construction packages is $53 million. Bid Package 1 was awarded by the Authority Board to Bay Cities Paving and Grading on June 29, 2004. In accordance with the JEPA,the project plans and design must be approved by each member agency prior to project construction. The attached resolution will fulfill this requirement by the County. The City Councils of Antioch,Brentwood and Oakley have taken or will soon take similar action. It is also proposed that the Board delegate the Authority Board to act on its behalf to approve the design,project plans and specifications of future phases of the Bypass to expedite its construction. CONSEQUENCES OF NEGATIVE ACTION: If the Board does not approve the attached resolution, it may result in a negative impact to the County due to a reduced or nonexistent level of immunity related to possible claims and/or lawsuits.
