SUBJECT: ,Accepting completion of private improvements (Coggins Square Condominiums),
Subdivision 98-08229,Pleasant Hill - BART area. (District IV)'
The Public Works Director has notified this Board that the private improvements (Coggins
Square Condominiums) in Subdivision 98-08229 have been completed as provided in the
Subdivision Agreement with Bart Lofts,L.L.C.,heretofore approved by this Board in conjunction
with the filing of the Subdivision Map.
NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of June 22,2004 thereby establishing the six-month terminal period for the filing of liens in case
of action under said Subdivision Agreement:

SUBJECT: Accepting completion of private improvements (Coggins Square Condominiums),

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $80,250.00,
Bond No. 3SM98290300 issued by the above surety be RETAINED for the six month lien
guarantee period until December 22,2004,at which time the Clerk of the Board is AUTHORIZED
to release the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the private improvements have been COMPLETED
and are NOT ACCEPTED NOR DECLARED as County roads, at this time.
BE IT FURTHER RESOLVED that there is no warranty period required, and the Public
Works Director is AUTHORIZED to refund the$1,600.00 cash security for performance(Auditor's
Deposit Permit No.349871,dated May 10,2000)plus interest in accordance with Government Code
Section 53079, if appropriate, to Holiday Development pursuant to the requirements of the
Ordinance Code; and the subdivision agreement and the performance surety bond are
EXONERATED.
BE IT FURTHER RESOLVED that the Public Works Director is AUTHORIZED TO PAY
to the Public Works Department the$5,000.00 cash deposit(Auditor's Deposit Permit No.355049,
dated August 22, 2000) made by Bridge Housing Corporation (Deficiency Bond to ensure
completion of sidewalk improvements on Subdivision 98-08229)plus all accrued interest to help
defray inspection charges incurred by the Public Works Department on DP 98-03006.

No. 329090, dated March 23,1999) and Subdivision 8229s $5,000.00 cash performance
bond (Auditor's Permit No. 355049, dated August 22,2000) to the Contra Costa County
Public Works Department to pay for outstanding overages on DP 98-03006, and will pay
the new balance due below:
