Under Gov. Code Section 31521.2, personnel of the County Employees' Retirement Association (CCCERA) are subject to the County's merit system rules and covered by any Memoranda of Understanding entered into between the County Board of Supervisors and recognized employee organizations. 2. The Board has considered the County Employees' Retirement Association (CCCERA) staff reduction plan as it pertains to the affected position and ratifies the action taken by the County Employees' Retirement Association (CCCERA). 3. The reduction is in recognition of the reduction in workload as a result of a Retirement Association custodial bank change. 4. The Board of Retirement authorized said abolishment of position and layoff at their May 19, 2004 meeting. 5. CCCERA will issue layoff notice as necessary, and give notice to the affected employee impacted by this action. 6. The Labor Relations Officer shall give notice of this Resolution to the recognized employee organization representing the employee impacted this action. 7. CCCERA has offered to meet with the recognized employee organization upon request concerning this resolution. 8. This action is taken without prejudices to pending consulting, meeting, and meeting and conferring with recognized organizations. 9. The Board of Retirement remains the governing body as to its officers and employees, such than it retains the ultimate authority, as recognized in Concoran v. Contra Costa County Employees Retirement Board((1997)64 Cal.AppAth 89),to appoint, promote and discharge the officers and employees who work as staff of the Contras Costa County Employees'Retirement Association. The Board of Retirement has delegated to the"Retirement Administrator, however, the authority to carry out all personnel actions as to officers and employees who report directly or indirectly to the Administrator, as is required for the proper management of CCCERA. This delegation of authority has been in place since the Administrator's hire. It is the Board of Retirement's intent that this delegation of authority will continue into the future. In delegating this authority to the Administrator, the Board of Retirement retains complete authority to supervise the actions of the Administrator, pursuant to Section 31522.2 of the Government Code. The Board of Retirement also retains the right to be apprised of all material personnel actions, such as hiring and laying off personnel working at CCCERA who report directly or indirectly to the Administrator, such that the Board of Retirement may take action if it deems appropriate. All personnel actions shall,be in accordance with applicable merit system regulations, or equivalent local rules, and, where applicable, the terms and conditions of employment established by the board of.supervisors for county employees, including those set forth in any applicable memorandum of understanding. 1 hereby certify that this is a true reflection of an action taken and entered in the minutes of the Retirement Board on the date shown.
