Code § 25526.5 SUBJECT: ADOPT Resolution No. 2004/ approving the conveyance of Flood Control and Water Conservation District interest in real property to the City of Antioch,in connection with Drainage Area 56, Channel Z, East Antioch Creek. [CP#03-42] Project No. 7566-6D8719 Antioch Area. District V The Board of Supervisors of Contra Costa County, as the governing body of the Contra Costa County Flood Control and Water Conservation District RESOLVES THAT: The project will not have a significant effect on the environment, and DETERMINES that the project is exempt from the requirements of the California Environmental Quality Act(CEQA)as a Class 12 Categorical Exemption under Section 15312 of the State CEQA Guidelines, and DIRECTS the Director of Community Development to file a Notice of Exemption with the County Clerk and DIRECTS the Public Works Director to arrange for payment of a $25.00 handling fee to the County Clerk for filing and a $25.00 fee to Community Development for processing of the Notice of Exemption. This activity has been found to conform to the General Pian of the City of Antioch. Contra Costa County Flood Control and Water Conservation District acquired certain real property by Final Judgment of Condemnation on April 11, 1990 in Volume 15781 of Official Records at page 966 in the Antioch area. The properties described in Exhibits"A-1", "A-2" "A-3", "A-4", and shown on Exhibits"B-1","B- 2", and "B-3" attached hereto, for said project is DETERMINED to be no longer necessary for District use. Conveyance of these properties to the City of Antioch will provide maintenance and continued use as a Flood Control facility for public purposes. This Board hereby APPROVES and AUTHORIZES the conveyance of said interest to the City of Antioch, pursuant to Government Code Section 25526.5, and the Chair, Board of Supervisors, is hereby AUTHORIZED to execute a Quitclaim Deed on behalf of the District, in accordance with the maintenance of Drainage Area 56, Channel Z, East Antioch Creek. The Real Property Division is DIRECTED to cause said Quitclaim Deed to be delivered to the grantee for acceptance and recording.
