SUBJECT: Accepting completion of public right-of-way landscaping improvements for
Subdivision 7686,Byron area. (District IM
The Public Works Director has notified this Board that the public right-of=-way landscaping
improvements in Subdivision 7686 and Subdivision 8143 which include the east side of Bixler Road
from the southern end of the development (southwest corner of APN 011-350-007) to Newport
Drive; both sides of Newport Drive from Bixler Road to the southern edge of the development(at
Newport Lane); as well as all the improvements at Slifer Park(APN 011-350-003)and the landscape
improvements at the Park and Ride Facility(APN 011-350-008). Such improvements have been
completed as provided by the Subdivision Agreement(Right-of-Way Landscaping)with Talisman
Realty Group, Inc.,heretofore approved by this Board on March 7, 2000.

SUBJECT: Accepting completion of public right-of-way landscaping improvements for
Subdivision 7686, Byron area. (District III)

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of May 4,2004 thereby establishing the six-month terminal period for the filing of liens in case of
action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $56,350.00,
Bond No. 11119463542 issued by the above surety be RETAINED for the six month lien
guarantee period until November 4,2004, at which time the Clerk of the Board is AUTHORIZED
to release the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby
established,and the$1,000.00 cash deposit(Auditor's Deposit Permit No. 342940,dated December
29, 1999) made by Talisman Realty Group, Inc. and the performance/maintenance surety for
$112,700.00,Bond No. 11119463542 issued by The American Insurance Company be RETAINED
pursuant to the requirements of Section 94-4.406 of the Ordinance Code until release by this Board.
