SUBJECT: Accepting completion of public improvements and declaring certain roads as county
roads, and accepting completion of warranty period and release of cash deposit for
faithful performance, Subdivision 8118,Pacheco area. (District IV)
The Public Works Director has notified this Beard that the publicimprovements in
Subdivision 8118 (Carriage Lane, Manor Park Circle, and the widening of High Street)have been
completed as provided in the Subdivision Agreement with Western Pacific Housing-Glen View,
LLC, heretofore approved by this Board in conjunction with the filing of the Subdivision Map.
NOW THEREFORE BE IT RESOLVED that the public improvements have been
COMPLETED as of March 23, 2004 thereby establishing the six-month terminal period for the
filing of liens in case of action under said Subdivision Agreement:

SUBJECT: Accepting completion of public improvements and declaring certain roads as county
roads, and accepting completion of warranty period and release of cash deposit for
faithful performance, Subdivision 8118, Pacheco area. (District IV)

BE IT FURTHER.RESOLVED the payment(labor and materials) surety for$178,150.00,
Bond No. 1377419 issued by the above surety be RETAINED for the six month lien guarantee
period until September 23,2004,at which time the Clerk of the Board is AUTHORIZED to release
the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that Carriage Lane and Manor Park Circle the hereinafter
described roads,as shown and dedicated for public use on the Final Map of Subdivision 8118 filed
November 10, 1998, in Book 444 of Maps at Page 15, Official Records of Contra Costa County,
State of California, are ACCEPTED and DECLARED to be County road(s).'

BE IT FURTHER RESOLVED that the widening of High Street is ACCEPTED and
DECLARED to be a County road; as shown and dedicated for public use on the final map of
Subdivision 8118 filed November 14, 1998, in Book 404 of Maps at page 15, Official Records of
Contra Costa County, State of California.
On March 23, 2004, this Board resolved that the improvements in Subdivision 8118 were
completed as provided in the Subdivision Agreement with Western Pacific Housing - Glen View
LLC and now on the recommendation of the Public Works Director,
The Board hereby FINDS that the improvements have satisfactorily met the guaranteed
performance standards for the period following completion and acceptance.NOW THEREFORE BE
IT RESOLVED that the Public Works Director is AUTHORIZED to refund the 3,600.40 cash
deposit(Auditor's Deposit Permit No.319488,dated September 8, 1998)plus interest,if applicable,
to Western Pacific Housing—Glen View,LLC in accordance with Government Code Section 53079,
Ordinance Code Section 94-4.406.
NOW THEREFORE BE IT RESOLVED that the warranty period has been completed and
the Subdivision Agreement and performance/maintenance surety bond for$352,704.00,Bond No.
1377419, are exonerated.
