NONE ABSTAIN. NONE RESOLUTION NO. 2€04112' SUBJECT: Accepting completion of warranty period and release of cashdeposit for faithful performance, Subdivision 7908, Byron area. (District III) On November 6,2041,this Board resolved that the improvements in Subdivision 7908 were completed as provided in the Subdivision Agreement with Centex Homes and now on the recommendation of the Public Works Director; The Board hereby FINDS that the improvements have satisfactorily Imet the guaranteed performance standards for the period following completion and acceptance.NOW THEREFORE BE IT RESOLVED that the Public Works Director is AUTHORIZED to refund the $5,300.00 cash deposit(Auditor's Deposit Permit No.275888,dated April 1, 1996)plus interest in accordance with Government Code Section 53079 and Ordinance Code Section 94-4.406, if appropriate to Centex Homes. BE IT FURTHER RESOLVED that the warranty period has been',completed and the Subdivision Agreement and the performance surety bond, Bond No. 5868529 issued by Safeco Insurance Company of America, is EXONERATED.
