............. BEFORE THE BOARD OF SUPERVISORS> OF THE COUNTY OF CONTRA. COSTA 2 STATE OF >CALIFORNIA 3 In the Matter of Resolution 4 for Conde nation of Drainage Easement for Drainage from COWDDMTION 5 Marsh Creek Mobile> Rome Park, RESOLUTION NO. 71/_8_ Unit No. 2,, Marsh Creek Area. 6 7 The Board of Supervisors of Contra Costa County., California,, by vote 8 of two-thirds or more of all its members, RESOLVEs THAT: 9 It finds and determines and hereby declares that the public 10 interest and necessity require: 11 The acquisition, construction and completion by the County of 12 Contra Costa., of a public improvement; and in connection >therewith 13 and necessary therefor, the acquisition of two of flood control 14 drainage easements over and upon private property within the unincor- 15 porated area of Contra Costa County owned by EVMYN G. GRIFFITH, as ., 16 to an undivided one-half interest, and R. C. GRIFFITH., also known as 17 ROY C. GRIFFITH., as to an undivided one-half interest, said easements 18 being more particularly described in Appendix "A" attached hereto 19 and made a part hereof. 20 Said proposed public improvement is plannedand located in the 21 manner which will be most compatible with the greatest public good, 22 and the least private injury'; 23 This Board shall acquire in the name of the County of Contra 24 Costa., the said real property and interests therein by donation., 25 purchase,, or by condemnation in accordance with the provisions for 26 eminent domain in the Code of Civil Procedure; 27 The County Counsel of this County is hereby authorized and 28 empowered: 29 To acquire In theCount Is y rume by c:*n4***tjb,h�0 :t'f`j6 titles, 30 easements and rights of Way h re 0 e J.habove dere i bed i :Ahd t: the said 31 real property Or interests therein 9 with 1 in accordanceth the provisions 1 for eminent domain in the Cade of Civil Procedure and. the Constitution 2 of California, for County drainage 'purposes;, drainage easements over 3 real 'property as described in Appendix "A" attachedhereto. 4 To prepare and prosecute in the County's name such proceedings 5 in the proper court as are necessary for such acquisition, and 6 To apply to said court for an 'order fixing the amount and nature 7 of such security as it may direct, and to deposit such security as 8 so directed, and for an order permitting the County to take immediate 9 possession and use of said real property or interests therein for 10 said public uses and purposes, 11 The said: real property and interests in real property are more 12 particularly described in Appendix "A" attached hereto and by this 13 reference made a part ,hereof to the same extent` as if herein fully 14 set forth in 'words and. figures. 15 PASSED AND ADOPTED on January , 1971.0 by the following vote 16 AYES: Supervisors - Dias, Moriarty, Boggess, Linsche d, Kenny;. 17 1'OES.
