SUBJECT: ADOPT Resolution No. 2003/ 532 to summarily vacate an excess portion of Wharf
Drive, Bay Point area. District V [CDD-CP#02-34].

The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer required for
street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and
Highways Code,commencing with Section 8330,et.seq. A description of the offered area to be vacated
is attached in Exhibit "A"and attached hereto.
This vacation request is for an excess right of way for a street or highway not required for street
or highway purposes. (S. &H. Code Section 8334).
This Board declares that the hereinabove described proposed vacation is HEREBY ORDERED
VACATED subject to any reservation and exception described in Exhibit"A"attached hereto. From
and after the date this Resolution is recorded,the portion vacated no longer constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.

PARCEL 3 - Vacation
Real property in an unincorporated area of the County of Contra Costa, State of California,
being a portion of the northeast one-quarter of Section 9, Township 2 North, Range 1 West,
Mount Diablo Meridian, described as follows:
Commencing at the east one-quarter corner of Section 9, being an iron pipe monument as
shown on the Right of Way drawing entitled "Pacifica Avenue West Of Shore Acres Unit#2"-on
file in the Public Works Department of said County as RW-50946-57-1; thence westerly along
the survey line as shown on said drawing (RW-5094B-57-1) north 89°38'35" west, 1915.27
feet; thence leaving said survey line north 0042'02" east, 30.00 feet to a point on the northerly
Right of Way line of Pacifica Avenue as shown on said Right of Way drawing (RW-5094B-57-
1); thence westerly along said northerly line north 89038'35" west, 61.31 feet to the Point of
Beginning; thence leaving said northerly line and said Point of Beginning north 18°18'46" east,
52.03 feet; thence north 0"13'00" east, 438.75 feet; thence north 89°1758" west, 20.72 feet to
the northeast corner of the parcel of land as granted to Charles Culbreath recorded December
18, 1995 in series number 95-218808, Contra Costa County records; thence southerly along
the east line of said parcel south 0042'02" west, 100.00 feet to the southeast corner of said
parcel of land; thence leaving said corner south 0°42'02" west, 368.50 feet to a point on a
tangent curve, concave to the northwest, a radial from said point bears north 89°17'58" west;
thence southwesterly along said curve, having a radius of 20.00 feet, through a central angle
of 89°39'23", an arc length of 31.30 feet to a point on the northerly Right of Way line of Pacifica
Avenue as shown on said Right of Way drawing (RW-50946-57-1); thence easterly along said
northerly line south 8903835" east, 28.56 feet to the Point of Beginning.
Containing an area of 10,809 square feet of land (0.2482 acres), more or less.
Bearings are based on the California Coordinate System of 1983 (CCS83), Zone III.
Distances given are ground distances.
