RESOLUTION NO. 2003/ 531
SUBJECT: Approve and Authorize the California Highway Patrol to enforce the California
Vehicle Code on private streets in Windemere Phase I, being developed by
Windemere BLC Land Company, L.L.C., as recommended by the. Public Works
Director, in the San Ramon(Dougherty Valley) area. (District III)
IT IS BY THE BOARD RESOLVED that the California Highway Patrol is authorized to
enforce the California Vehicle Code on private streets in Windemere Phase I. The Contra Costa
County Public Works Department received a petition on August 18, 2003 from Windemere BLC
Land Company,L.L.C.requesting California Highway Patrol enforcement of the California Vehicle
Code on private streets in Windemere Phase I in the San Ramon(Dougherty Valley) area; and
WHEREAS,under California Vehicle Code section 21107.5,the California Highway Patrol
may provide vehicle code enforcement on private streets upon enactment by a county resolution;and
WHEREAS,upon formal acceptance by the City of San Ramon of Windemere Phase I streets
as public roadways, the City of San Ramon Police Department will be responsible for the
enforcement of the vehicle code; and
NOW, THEREFORE,BE IT RESOLVED,that the Board of Supervisors of the County of
Contra Costa does hereby approve and authorize the California Highway Patrol to enforce the
California Vehicle Code on private streets in Windemere Phase I subject to the following conditions:
1. All private streets must meet applicable traffic engineering standards.
2. The installation of signage indicating the private streets is subject to California Vehicle Code
enforcement.

Subject: Petition to County for CHP enforcement on roads not yet accepted by the County per
California Vehicle Code 21107.5.
Dear Larry,
The purpose of this letter is to formally petition the County for CHP enforcement on roads not
yet accepted by the County. I have attached a map identifying which roads are paved but not
formally accepted by the County and are ready for enforcement by the CHP. Please take this
item to the County Board of Supervisors so that CHP enforcement can begin.

Excerpt from California Vehicle Code Section 21107.5
21107.5. (a) Any city or county may, by ordinance or resolution, find and declare that
there are privately owned and maintained roads as described in the ordinance or
resolution within the city or county that are generally held open for use by the public
for vehicular travel and which so connect with highways that the public cannot
determine that the roads are not highways. Upon enactment by a city or county of the
ordinance or resolution, this code shall apply to the privately owned and maintained
read, except as provided In subdivision (b). (b) No ordinance or resolution enacted
under subdivision (a) shall apply to any road on which the owner has erected a notice
of a size, shape, and calor as to be readily legible during daylight hours from a distance
of 100 feet to the effect that the read Is privately owned and maintained and that It Is
