SUBJECT: ADOPT Resolution No.200310oapproving the Termination of porton of an Offer
of Dedication of an excess right of way located in San.Damon,described as a portion
of LOT 10, Subdivision 7976 (436 M 29). [SCH#91053014]

The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Termination of a portion of an Offer of Dedication of a certain excess right of way not
required for street,highway landscaping and other related purposes,including maintenance therof,is
made pursuant to Government Code Section 7050 and to Division 9,Part 3,Chapter 4 ofthe Streets
and Highways Code,commencing with Section 8330,et.seq. A description of the offered area to be
terminated is attached hereto as Exhibit "A", shown on Exhibit "B", and incorporated herein by
reference located in the San Damon area.
This termination request is for an excess right of way not required for street or highway
purposes. (S. &H. Code Section 8334).

SUBJECT: Approve the Termination of a portion of an Offer of Dedication.
DATE: August 5, 2003

The Board of Supervisors previously certified the Environmental Impact Report(EIR)for the
"Dougherty Valley General Plan Amendment Specific Plan,and Related Projects"(County File 2-
91-SR; SCH# 91053014). This termination of Offer of Dedication is covered by this EIR.
Considering all facts before it,this Board FINDS there is no reasonable probability that the
County will accept this said portion of the offered roadway into the County road system, that no
public money has been expended for maintenance of this said portion of the offered area and that it is
in the best interest of the County and the public that this said portion of the offered area be privately
owned and maintained.
This Board hereby TERMINATES the hereinabove described said portion of the offer of
dedication and ABANDONS the right of the County to accept this said portion of offer. The Board
is not aware of any existing in place utilities in the subject area.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.
From and after the date this resolution is recorded,this said portion of the offer of dedication
is terminated and the County's right to accept this said portion of the offer is abandoned.
