HomeMy WebLinkAboutRESOLUTIONS - 01012003 - 2003-417 Resolution No. 2003/ 417 A RESOLUTION OF APPLICATION BY THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS REQUESTING THE CONTRA COSTA LOCAL AGENCY FORMATION COMMISSION (LAFCO)TO INTITIATE PROCEEDINGS FOR A JURISDICTIONAL CHANGE RESOLVED, by the Contra Costa County Board of Supervisors that it wishes to initiate proceedings pursuant to the Cortese-Knox Hertzberg Local Government Reorganization Act of 2000 for a change of organization (i.e., the dissolution of CSA M-8 from Contra Costa County and the concurrent annexation of CSA M-8 to the Discovery Bay Community Service District); and WHEREAS, a notice of intent to adopt this resolution of application has been given, and this Board has conducted a public hearing based upon this notification; and WHEREAS, the reason(s) for the proposed reorganization is to transfer the Parks, landscaping and street light facilities from Contra Costa County to the Discovery Bay Community Service District. WHEREAS, the following agency or agencies would be affected by the proposed jurisdictional change: Amenq Nature of Change Discovery Bay Community Services Dissolution/annexation District/Contra Costa County Service Areas M-8 WHEREAS, the territories proposed to be changed are inhabited (12 or more registered voters) and a description and map of the boundaries of territories are attached hereto as Exhibits A and B and by this reference incorporated herein; and WHEREAS, it is desired that the proposal be subject to the following terms and conditions(none); and WHEREAS, this proposal is consistent with the adopted spheres of influence for the affected agencies; and WHEREAS, this Board certifies that as lead agency pursuant to the California Environmental Quality Act it is Categorically Exempt. WHEREAS, this Board has determined that this proposal meets the criteria for a waiver of protest hearings as set forth in Government Code Section 56663; and UZOLUTION NO. 2003/417 Resolution No. 2003/ 417 June 24,2003 Page 2 NOW, THEREFORE, this Resolution of Application is hereby adopted and approved by the Board. of Directors and the Contra Costa Local Agency Formation Commission is hereby requested to take proceedings for the change of organization or reorganization as authorized and in the manner provided by the Cortese-Knox Hertzberg Reorganization Act of 2000. On Tuesday, September 17, 1958,�pursuant to Resolution No: 68/529, this Board held a hearing on the proposed formation of County Service Area No. M-8 as d'teiscribed. in Exhibit "A" attached hereto and by reference incorporated,hAreln. Notice of said hearing was duly given in the manner requ red-by law;.and this Board at said hearing heard the testimony of all interested persons or taxpayers for or against the establishment of County ,Service Area No. M-8. The said hearing was then continued to October 1, 1968, for decision. Written protests against the establishment of the area, or against the extent of the area, or against the furnishing of .specified types of extended services within the area, or against any other matters considered or resolved by this Board at this hear- ing on the establishment of the area, were not filed by fifty per- cent (50x) or more of the registered voters reg1ding within the territory proposed to be included in the area, or by the owners of one-half or more of the valtik of the land and improvements in the territory proposed to be included in the area, as shown by the last equalized assessment roll. The services described in Resolution No. 68/529, adopted by this' Board on September 17, 1968, are extended county services. A county service area to be known as "County Service Area No. M-8'" is hereby established pursuant to the provisions of the County Service.Area Law, Chapter 2.2 of Part 2 of Division 2 of Title 3 (commencing with Section 25210.1) of the Government Code of the State of California, in the unincorporated area or Contra Costa County, and the boundaries of the- area are 'hereby determined and established to be as •described in E;hibit "A" attached hereto and by this reference made a part hereof. The type of extended county services to be performed within County Service Area No. M-8 are the providing of street lighting services ,and parkway services limited to landscaping maintenance within public road rights-of-way.
