Approval of Levee Maintenance by the Discovery Bay Community Services District for Subdivision 85'70(DiscoveryBay West Village 3)and future Discovery Bay West Village 4 being developed by Hofmann Land Development Company, Brentwood area. (District M) DATE: June 3, 2003 PAGE 2 M. BACKGROUND/REASONS FOR RECOMMENDATIONS The conditions of approval for the Discovery Bay West Project(Subdivision 8570) require the developer,Hofmann Land Development Co.,to construct a levee system, to provide a plan for perpetual maintenance of the system, and to identify a maintenance entity, such as a homeowners association, acceptable to the Public Works Department. Regulations of the Federal Emergency Management Agency ("FEMA") require that a governmental agency have ultimate responsibility for maintenance of a levee system in flood hazard areas. The Discovery Bay Community Services District ("CSD") qualifies as a governmental agency to assume ultimate responsibility for perpetual maintenance of the Discovery Bay West levee system. In March 2003, the CSD obtained voter approval to exercise its latent powers to construct, maintain and operate flood protection works and facilities. In order to exercise these powers, the CSD must also obtain the consent of the County's Board of Supervisors pursuant to Government Code Section 61600(q)(2). The CSD has requested that the Board of Supervisors give such consent. The Public Works Department has reviewed that request and recommends that the Board give the requested consent. The CSD's maintenance of the levee system will not conflict with the authority of other public agencies, in that the levee system is not within the jurisdiction of Reclamation District No. 800 or the Contra Costa County Flood Control and Water Conservation District. NOW,THEREFORE,IT IS RESOLVED that upon LAFCO's approval, the Discovery Bay Services District is APPROVED to provide flood protection services. RESOLUTION N0. 2003/358
