Dept.: cc: Treasurer-Tax Collector (5 certified) County Administrator Auditor-Controller Assessor RESOLUTION NO. 2.003/311 c:IwpyvinHormslnsaiu.po AGREEMENT TO PURCHASE TAX-DEFAULTED PROPERTY This agreement Is made this 13th day of May 2003 by and between the Board of Supervisors of Contra Costa County, State of California, and CONTRA COSTA WATER DISTRICT("Purchaser"), pursuant to the provisions of Division 1, Part 6, Chapter 8, of the Revenue and Taxation Code. The real property situated within said county, hereinafter set forth-and described In this agreement is tax-defaulted and Is subject to the power of sale by the Tax Collector of said county for the nonpayment of taxes, pursuant to provisions of law. TERMS AND CONDITIONS It Is mutually agreed as follows: 1. that as provided by Section 3800 of the Revenue and Taxation Code, the cost of giving notice of this agreement shall be paid by the PURCHASER, and 2. that the PURCHASER agrees to pay the sum of$ 50.000.00 for the real property described in EXHIBIT"A"within 14 days after the date this agreement becomes effective. Upon payment of said sum to the Tax Collector, the Tax Collector shall execute and deliver a deed conveying title to said property to PURCHASER. If all or any portion of any Individual parcel listed in EXHIBIT "A" is redeemed prior to the effective date of this agreement, this agreement shall be null and void as to that individual parcel. This agreement shall also become null and void and the right of redemption restored upon the PURCHASER'S failure to comply with the terms and conditions of this agreement. RESOLUTION NO.03-09 Dianne R.Sow,Distdot secretary Contra Costa Water Distriot A RESOLUTION OF THE BOARD OF DIRECTORS OF CONTRA COSTA WATER DISTRICT AUTHORIZING THE GENERAL MANAGER TO PURCHASE THE 80-ACRE EKENBERCJDAWSON PARCEL FROM CONTRA COSTA COUNTY FOR$54:000 WHEREAS Contra Costa County has identified the 80-acre EkenberglDawson parcel adjacent to Los Vaqueros Watershed lands as one of many parcels scheduled to be sold at public auction on February 26, 2003 to recover delinquent taxes; and WHEREAS the District can secure this parcel for the minimum auction price of$50,000 through notification of the County Tax Collector and County Board of Supervisors of District's intent to purchase; and WHEREAS the 80 acre parcel's value is estimated at$4,000 to$5,000 per acre for a total value ranging from$320,000 to$400,000; and WHEREAS the parcel's terrestrial habitat could be maintained as protected species habitat in accord with District's Los Vaqueros Resource Management Plan.' THEREFORE BE 1T RESOLVED by the Board of Directors of the Contra Costa Water District that the General Manager is hereby authorized to purchase the 80-acre Ekenberg/Dawson parcel from Contra Costa County for the minimum auction price of $50,000. The General Manager is also authorized to file a written objection to the public sale of said parcel to the County setting forth the public value of having said parcel added to the 19,100 acres of land owned and controlled by the District at Los Vaqueros.
